Bayer AG subsidiary Monsanto has agreed to pay up to $7.25 billion over as many as 21 years to resolve claims that exposure to Roundup weedkiller caused non-Hodgkin’s lymphoma.

The long-term settlement program would cover both current plaintiffs and future claimants diagnosed before or within 16 years of final court approval, according to the filing.

Payments would be made annually and are subject to caps and declining funding levels over time. The agreement requires court approval before it can take effect.

The proposed class action settlement is part of a broader legal strategy tied to the U.S. Supreme Court’s pending review of Durnell v. Monsanto, a case that could determine whether state-law failure-to-warn claims are preempted by federal pesticide labeling rules.

A ruling in Monsanto’s favor could significantly limit future litigation, while the class settlement program is intended to resolve claims that would continue regardless of the Supreme Court’s decision.

“The proposed class settlement agreement, together with the Supreme Court case, provides an essential path out of the litigation uncertainty,” Bayer CEO Bill Anderson said in a statement.

Settlement aims to resolve tens of thousands of Roundup lawsuits

Attorneys involved in the negotiations said more than 40,000 Roundup personal injury claims involving non-Hodgkin’s lymphoma were already pending in court or subject to tolling agreements, with new filings continuing.

Plaintiffs’ firms said the proposed program would replace an earlier four-year settlement framework that collapsed in 2020. The new structure is designed to provide a single, long-term claims program covering both occupational and residential exposure, while allowing class members to opt out and pursue individual lawsuits if they choose.

According to statements from plaintiffs’ counsel, the program is intended to fairly compensate tens of thousands of pending Roundup plaintiffs and establish a predictable process for future claims.

Payments under the settlement are expected to begin this year if approved.

Roundup, whose active ingredient is glyphosate, has been the subject of years of mass tort litigation alleging it causes cancer. Bayer acquired Monsanto in 2018 for $63 billion and inherited the company’s Roundup liabilities as lawsuits surged nationwide.

The litigation has included several headline-grabbing verdicts, including a nearly $2.1 billion Georgia verdict in 2025 and earlier California jury awards that were later reduced.

In addition to the proposed Roundup class action settlement, Monsanto disclosed separate confidential settlements resolving other glyphosate cases and several remaining polychlorinated biphenyls (PCB) verdicts tied to a Washington state school.

Last month, Bayer agreed to a $4.85 million settlement over claims its Lotrimin and Tinactin antifungal sprays contained benzene, a known carcinogen.
