A man has filed a claim within the Bard blood clot filter multidistrict litigation alleging that he suffered personal injury as a result of the medical device.
Plaintiff Hughey L. has named C.R. Bard Inc. and Bard Peripheral Vascular Inc. as defendants. Hughey states that he was implanted with the G2 Vena Cava Filter on January 11, 2007 prior to suffering unspecified injuries.
Hughey has raised claims in his Bard blood clot filter lawsuit including strict products liability for manufacturing defect, design defect, information defect (failure to warn), failure to recall/retrofit, negligent misrepresentation, negligence per se, breaches of express and implied warranty, fraudulent misrepresentation, fraudulent concealment, and violations of North Carolina law prohibiting consumer fraud and unfair and deceptive trade practices.
The plaintiff is seeking a jury trial and is seeking unspecified damages. His IVC filter lawsuit will join several others like it that have already been consolidated into a multidistrict litigation, or MDL.
The Bard Blood Clot Filter Lawsuit is Case No. 2:17-cv-01085-DGC and is part of the Bard Blood Clot Filter MDL In re: Bard IVC Filters Products Liability Litigation, MDL No. 2641, in the U.S. District Court for the District of Arizona.
What is the Bard Blood Clot Filter?
The Bard blood clot filter is a specific brand of inferior vena cava filter, or IVC filter. This small medical device is designed to prevent blood clots from causing further damage in the body.
The tiny, cage-like device is surgically implanted within a patient’s vena cava, the body’s largest vein, which carries blood from the extremities back to the heart and lung. When blood clots form in this vein, they can travel to the heart and lungs, causing conditions such as stroke, heart attack, and pulmonary embolism, all which can be fatal.
Essentially, the Bard blood clot filter acts as a small trap designed to catch blood clots before they travel to cause damage. While these medical devices can be very helpful for patients who are unable to take oral anticoagulant medications to prevent blood clots, they are not without potential complications. Some of these complications include:
- Fracture of the filter
- Tilting of the filter, rendering it less effective or completely ineffective
- Migration of the entire filter or fractured pieces to other parts of the body
- Organ or blood vessel perforation by the device
- Difficulty removing the IVC filter
The complications that may arise from Bard blood clot filter use can lead to serious impairment or even death for some patients.
Legal Action Against the Makers of the Bard Blood Clot Filter

The Judicial Panel on Multidistrict Litigation approved the consolidation of all Bard blood clot filter lawsuits for pretrial proceedings because there were so many federal claims filed with similar allegations against the manufacturer.
Consolidating these IVC filter lawsuits allows for the streamlining of the judicial process and can help conserve resources such as time and finances of all involved.
