A consumer filed a class action lawsuit against Bank of America saying the bank does not legitimately investigate fraud claims, instead sending out form letter denials arguing its customers are responsible for banking fraud.

The lawsuit alleges that the company often denies Bank of America fraud claims — even when they are submitted properly — by claiming that fraudulent payments were actually made by an authorized card user.

“Despite Plaintiff’s request for an explanation and further review, and submitting a police report for the stolen card and fraudulent transactions, Bank of America mechanically rejected Plaintiff’s claim without performing a reasonable investigation and instead, issued form denial notices devoid of any factual findings or documentation from its alleged investigation,” the Bank of America class action says.

Bank of America class action: Legitimate fraud claims must be covered, lawsuit says

Congress determined that banks are required to pay for financial fraud reported by consumers in a timely manner, unless the bank can determine the charges were not fraud, the lawsuit says. Banks must write a detailed explanation and provide all available documentation to prove the charges are not fraud, allowing consumers to dispute the conclusions.

The Bank of America fraud claims responses attempt to flip the responsibility of proof and financial loss on the consumer, the lawsuit claims.

“Bank of America denies fraud claims for transactions it unilaterally deems to be ‘authorized’ by Plaintiff without providing any substantive explanation as to how or why it has satisfied its burden of demonstrating that the disputed charges were in fact authorized,” the lawsuit says.

A consumer filed a class action lawsuit against Bank of America claiming the company did not send required monthly statements to customers who fell behind on their home equity lines of credit.

    I was hit with multiple fraud cases when I was hacked in both 2023 and this year.
    Total was over 284000.00

    I am yet to recover from this even though I have given of the necessary documentation to properly prove that I didn’t do this.

    I would appreciate proper funding returned to me effective immediately.

    The exact same thing happened to me. After I was SCAMMED 7K thru my business account with BOA. I OFFERED DOCUMENTS AND POLICE REPORTS they wouldn’t take it. And I had to wait 50 business days for the investigation but they didn’t do anything other than reach out to the other bank and wait for them to respond to the witch of course they didn’t. That really fucked my life up in a major way I will never forgive them for that.

    I have proof I gave them proof and they kept giving me strange requests. No matter what I do it’s not good enough and they just keep denying it. They don’t even send me letters or communication after the first 2. They make it impossible and they do nothing. I had proof and I even had the companies reach out to me to try to make it better and they still did not care. They owe me money and I will never trust them again
    I hope we can join a lawsuit because they are HORRIBLE! They lie and they don’t care, at all. They are a fraud!
    They caused emotional distress. I had to take anxiety pills. I was on the phone with them over 40 hours a week. I tried for 5 months and gave up because they wouldn’t even contact me with a letter they just lied over the phone after a dozen times

    I did several disputes over the same transaction and gave them every piece of proof, and they kept denying it asking me to do weird things that made no sense.
    I would love to have a lawsuit against them. They are mean unprofessional and they are boldfaced liars

    I was scammed out of $13,000 from two Zelle transactions from two different checking accounts on July 20, 2024 and $13.05 using my debit card on July 19, 2024. I do not use debit cards. It was only used as an ID when I went into a branch. I filed a dispute on July 19th and another on July 20th. The bank froze those three accounts. I’m going to the branch to open a new account. I’m waiting for the bank to investigate my claims.

    I was scammed twice and BofA gave me a very convincing story about the fact that what happened was going on a lot and it should be no problem to get my money back. But that never happened. Next thing I knew I was getting a letter in the mail stating my case was being denied. Please add me.

    We were recently scammed on May 10, 2024 in the amount’s of over $100,000 They have denied all of our appeals and are not being held responsible to reverse the wire’s. Now we don’t know if we can keep our business afloat through the rest of this year

    I was scammed last year (2,220) a week before Christmas before the 15 days of investigation was over. I received the same results. And I was told there was nothing that they could do. After I even emailed them the proof. So yes I would like to be add to this
