A consumer filed a class action lawsuit against Bank of America saying the bank does not legitimately investigate fraud claims, instead sending out form letter denials arguing its customers are responsible for banking fraud.

The lawsuit alleges that the company often denies Bank of America fraud claims — even when they are submitted properly — by claiming that fraudulent payments were actually made by an authorized card user.

“Despite Plaintiff’s request for an explanation and further review, and submitting a police report for the stolen card and fraudulent transactions, Bank of America mechanically rejected Plaintiff’s claim without performing a reasonable investigation and instead, issued form denial notices devoid of any factual findings or documentation from its alleged investigation,” the Bank of America class action says.

Bank of America class action: Legitimate fraud claims must be covered, lawsuit says

Congress determined that banks are required to pay for financial fraud reported by consumers in a timely manner, unless the bank can determine the charges were not fraud, the lawsuit says. Banks must write a detailed explanation and provide all available documentation to prove the charges are not fraud, allowing consumers to dispute the conclusions.

The Bank of America fraud claims responses attempt to flip the responsibility of proof and financial loss on the consumer, the lawsuit claims.

“Bank of America denies fraud claims for transactions it unilaterally deems to be ‘authorized’ by Plaintiff without providing any substantive explanation as to how or why it has satisfied its burden of demonstrating that the disputed charges were in fact authorized,” the lawsuit says.

A consumer filed a class action lawsuit against Bank of America claiming the company did not send required monthly statements to customers who fell behind on their home equity lines of credit.

    I lost over $3,000 due to fraud and Bank of America said it was my fault and that the bank could not reimburse me my money. I filed a police report and after they investigated my case the police said that because; of the nature of the case that I would need to notify and write to the FBI. I did write a letter to the FBI and have no response. Wow! Who is going to be held accountable for scammers stealing Senior Citizens money from their banking accounts? Fraud and Abuse is just not right.

    $5000 Zelle transferred to my account and then I’m negative $5000 after and when I called they gave me the run around and still send me letters about the account balance being negative. They do not investigate fraud claims properly

    I lost $3,480 in my Bank of America checking account on May 31, 2023 due to a fraudulent Zelle transfer. Bank of America initially lied to me and told me that they would reimburse the loss. In the end they did not give me a red cent and even refused to give me an affidavit of dispute. This prevented me from filing a police report with the NYPD.

      I don’t even bank with banks anymore due to the same situations are in regards to Bank of America Chase Capital One and other financial institutions that have caused me great great brief not only to say just a financial burden but the misery that the financial burden is caused these financial institutions are supposed to be there for you as a customer but then they turned against you as an enemy that you can’t really fight they have the upper hand and that is not fair for the consumer we pay for services that are not rendered to us and we have to freaking fight for our own our own rights that are already services that should be provided for the fees that are provided you know to these Banks I mean they’re FDIC insured right but what does that really mean I mean that doesn’t mean nothing really because all you ever get from the bank is that what and you’re responsible sorry for you and the freaking banks are a Ponzi scheme in the first place dude I’ve lost over $100,000 due to Banks man and I tell you what they ain’t worth the crap anyways they lost 240 billion dollars in equity last year they just closed in 2023 late but I’m bad investments man where the heck did they get all that money that’s where your money went that’s where I’m going with this I need information on how to get a hold of a lawyer that actually could do something with these matters I’ll give you all my money that you freaking get back from me man just to go ahead and put these banks on blast and they get bailed out by the government what a blasphemy man only freaking banking financial institution I know that would be even solid in in a thought would be Charles Schwab man that’s because you become your own banker pretty much with your own investments that’s a shout out to Charles Schwab just sucks because I had bad freaking things happen with other Banks I can’t get a Charles Schwab account because of this damn Banks put in the hindrance in my life taking my money and giving me a black mark because of fraud I feel like I’ve been frauded by the Banks man

    I had fraud charges on my Bank of America account. Someone bought a bunch of cryptocurrency. I filed for fraudulent activity. They opened an “investigation” then found me at fault. My account was closed and still affects me to this day.

    BofA open to unauthorized checking account in my name abd they remained open for 17 months. They put up a brick wall and refuse to resolve the issue.
