A new class action lawsuit claims Bank of America failed to respond to requests for information and requests to correct errors related to borrowers’ residential mortgage loans.

Plaintiff Lynne Warshaw claims in the Jan. 24 lawsuit that Bank of America refused to provide call recordings to which borrowers are entitled, gave the illusion of timely responses to borrowers’ requests despite not actually sending them on time, and misled borrowers as to how long the bank had to respond to such requests.

Warshaw wants to represent a class of Florida loan borrowers who submitted a request for information or notice of error to Bank of America and received a letter claiming the bank had 30 days from its own response date to send the information, rather than 30 days from the borrower’s request.

She also wants to represent a class of U.S. loan borrowers who submitted a request for information or notice of error to Bank of America requesting copies of call recordings between themselves and their mortgage servicer, and that the bank refused to provide.

Finally, Warshaw wants to represent a class of U.S. loan borrowers who submitted a request for information or notice of error to Bank of America and received a response letter that was dated within the response deadline and contained a postmark date that occurred after the response deadline.

Bank of America failed to provide requested call recordings, class action says

Warshaw claims Bank of America is guilty of violating the Florida Consumer Collection Practices Act and the Real Estate Settlement Procedures Act. She demands a jury trial and requests declaratory and injunctive relief and an award of actual and statutory damages for herself and all class members.

Late last year, Bank of America agreed to a $3.25 million class action settlement to resolve claims it failed to send proper notices to Pennsylvania borrowers after repossessing their vehicles.

    BOA..took me thru 3 different modifications even though I always paid mortgage payments only to be denied each time without having missed a payment…i submitted documents w lawfirm who never helped only to say house was foreclosed 2012 – 2013 I lived in home 8 yrs before fanni may and countrywide sold to BOA

      Bank of America is still the same. They did this to me for 3 years. They were the final bank have many servicer changes from 2009-2012. I tried for modification’s after all the mortgage increases. I asked for help from a realtor friend who claimed to know what B of A needed. The realtor suggested selling my home. I was against this, but after two years of B of As’ lies, stalling and not applying my payments to mortgage. I became so upset. Realtor convinced to sell my home. This broke my heart. She said the home had to be listed at the appraisal. price, which I questioned. She explained short sale was all there was. They all capitalized on my hardship. Strangely the 1st offer was a Bank of A employee. They walked after 30 days. Looking back so many people took advantage of the mortgage fiasco. I after 12 years of rebuilding our business and surviving cancer am still trying to understand how a realtor who made 90k and a corrupt bank got my home and I am still trying to buy a home. I never received one red sent. Bottom line She gave my home to Bank of America.

    Bank of America ripples me off for my money. They owe me about $100,00. I have been trying to talk to someone about this matter at the bank and they always give me a appointment to talk to a manager, but they always try to rush me out when I be talking about my money and my account. So I have filed a suit about this.and my credit with them. I don’t owe the bank. They owe me.

    I was bullied by BoA . They let fraudulent transactions take my savings and won’t respond to my complaints. I had to hire forexfraudteam at gmail. Com to investigate the matter and prove my case. They only refunded me full amount after the investigation.

    BofA retaliated by giving me a 50-year mortgage: Notice of error to Bank of America from 2021 to 2022: Refuse to fix any of the Errors:
    Dates 08/2017, 07/20, 10/22: Plus they capitalize on my escrow. They made a ghost payment to Cook County: I sent a letter from Cook County refusing. Falsified documents they applied back into the being 02/13.

      I keep getting random charges on my bank of america I reported it and they give me my money back then take it back
