Bank of America engaged in deceptive business practices by failing to honor the terms of a credit card offer, a new class action lawsuit claims. 

Plaintiff Jean-Baptiste Boyer-Gomez’s class action lawsuit claims Bank of America advertised terms and conditions for a credit card offer that it later refused to honor.

Boyer-Gomez argues Bank of America applied a different offer to his account than what was advertised and refused to abide by the original terms, despite admitting it received numerous complaints from other individuals about the alleged bait-and-switch tactic.

“Plaintiff spent numerous hours attempting to investigate and rectify the situation,” the Bank of America class action says. “Ultimately, Defendant refused to honor its previous, contractually obligated and advertised terms and conditions.”

Boyer-Gomez wants to represent a nationwide class and Massachusetts subclass of consumers who applied for a Mastercard with an offer to earn 70,000 bonus miles plus 40 (experience points) after making $3,000 or more in purchases within the first 90 days of opening their account, and were not provided those rewards.

Class action claims Bank of America ‘unilaterally’ changed terms of credit card contract

Boyer-Gomez argues Bank of America had the original contract for his Mastercard “superseded” by a second promotional offer that provided 50,000 bonus miles and 60 XP after making $2,000 or more in purchases within the first 90 days.

“Defendant lured Plaintiff into a contract under specific terms, only to unilaterally change the terms after Plaintiff had already started performance and without any justifiable reason,” the Bank of America credit card class action says. 

Boyer-Gomez claims Bank of America violated the Massachusetts Consumer Protection Act and is guilty of breach of contract, breach of the implied covenant of good faith and fair dealing and unjust enrichment.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual and treble damages for himself and all class members.

Bank of America agreed to pay $3.25 million last year to end claims the company failed to send proper notices to Pennsylvania borrowers after repossessing their vehicles

    I am from EDD prepaid debit card services from Bank of America however, Bank of America has six different cars that have never been registered by me so they took the car saying that my $998 a week did not start until August 2021 September 14 2020 was my first payment. This is how they stole the first 12,000. I have screenshots of my mobile app that they turned off and took my money however, they could not get all of my because phones were off car was repossessed. I was evicted so I was displaced All in the course of following claims dispute trying to get EDG on board so they could stop what was happening to me. I have letters from Bank of America stating that they had error in my account and they’re very sorry for my inconvenience. However, they Bank of America states that what the claim numbers were Not attached to my account. after finally 7 to 8 complaints with consumers financial Bureau it has allowed me to obtain every single piece of evidence that the claim numbers were denied denied and then they said if they put it on my card and then they said that the claim numbers were attached to my card and I have all the documents the main one being Bank of America sent me a $466 check asking me to drop everything in except the check as financial compensation of my injuries as I stated, losing a car losing my home being evicted, and being homeless I am 59 years old now in the wheelchair reasonable accommodations Bank of America needs to make this right and I need help to recover my Funds and justice for Lifetime.
