A consumer is suing Badia Spices Inc. over claims the company fails to disclose that its ground ginger and cinnamon products contain lead.
Plaintiff Enya Kolker claims in a new class action lawsuit that Badia Spices fails to disclose that its ground ginger and cinnamon products contain unsafe levels of lead, which she describes as a “powerful neurotoxin.”
Kolker argues Badia Spices engages in “deceptive and misleading” business practices with respect to the manufacturing, marketing and sale of its ground ginger and cinnamon products.
“Defendant has improperly, deceptively, and misleadingly labeled and marketed its products to reasonable consumers, like Plaintiff, by omitting and not disclosing to consumers on its packaging that the products are contaminated with unsafe levels of lead,” the Badia Spices class action claims.
Kolker wants to represent a nationwide class and New York subclass of consumers who purchased Badia Spices ground ginger or ground cinnamon products during the class period.
Class action: Badia Spices ground ginger contains 973 parts per billion of lead
Kolker claims she had an independent lab test a Badia Spices ground ginger product that she purchased and that the test results showed it contained 973 parts per billion (ppb) of lead.
The U.S. Food and Drug Administration (FDA), by comparison, recommends a maximum of 10 ppb for fruits, vegetables, mixtures, yogurt, custards, puddings, and single-ingredient meats and a maximum of 20 ppb for single-ingredient root vegetables and dry infant cereals, according to the Badia Spices class action.
Kolker claims Badia Spices is guilty of unjust enrichment and breach of express warranty and of violating New York’s General Business Law.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory, punitive and treble damages for herself and all class members.
Last year, another cinnamon consumer filed a similar class action lawsuit against Badia Spices accusing the company of selling cinnamon powder contaminated with dangerous levels of lead.
