A new class action lawsuit accuses Avocado Mattress of falsely advertising sales and discounts on its products.
Plaintiffs Ashley Islas and Elizabeth Amill filed the class action complaint against Avocado Mattress on June 23 in California federal court, alleging violations of state and federal consumer laws.
Islas and Amill allege Avocado Mattress misled consumers with fake sales and discounts on its products. They claim these sales were advertised as being in effect for a limited time when they in fact were not, creating a false sense of urgency for consumers to make purchases.
The lawsuit alleges the company’s practices were deceptive and harmful to consumers, and violated California’s False Advertising Law, the Consumers Legal Remedies Act and the Unfair Competition Law as well as federal regulations.
Avocado Mattress engaged in ‘deceptive’ practices, lawsuit says
Islas and Amill claim they purchased mattresses from Avocado Mattress based on the company’s advertised discounts.
They say they believed they were getting a substantial discount on the products, only to later discover the sales were not genuine and the discounts were not as advertised.
The plaintiffs allege Avocado Mattress’s practices caused them and other consumers to overpay for products and make purchases they would not have otherwise made.
The lawsuit seeks to represent a class of all individuals who, while in the state of California and within the applicable statute of limitations period, purchased one or more Avocado Mattress products advertised at a discount on Avocado Mattress’s website.
The plaintiffs are suing for violations of California’s False Advertising Law, the Consumers Legal Remedies Act and the Unfair Competition Law as well as for breach of contract and warranty, unjust enrichment and negligent and intentional misrepresentation. They seek certification of the class action, damages, fees, costs and a jury trial.
In related news, Sleep Number Corp. faced a similar class action lawsuit alleging it used false reference prices for mattresses on its website and in brick-and-mortar stores to make consumers believe they were getting a bargain.
