AT&T class action lawsuit overview: 

  • Who: Plaintiff Marleen Rickard filed a class action lawsuit against AT&T Inc. 
  • Why: Rickard claims AT&T violated the Telephone Consumer Protection Act by placing telemarketing calls using an artificial or pre-recorded voice to non-account holders who did not provide express consent.  
  • Where: The class action lawsuit was filed in Indiana federal court. 

A new class action lawsuit alleges that AT&T placed unlawful telemarketing calls to non-account holders. 

Plaintiff Marleen Rickard’s class action lawsuit claims AT&T sent artificial or prerecorded voice messages to consumers with neither an account nor any business relationship with the telecom provider. 

Rickard argues AT&T violated the Telephone Consumer Protection Act (TCPA) by placing the calls as described above without prior express consent. 

“Upon information and belief, Defendant routinely violated (the TCPA) by using an artificial or prerecorded voice in connection with non-emergency calls it places to telephone numbers assigned to a cellular telephone service, without prior express consent,” the class action says. 

Rickard wants to represent a nationwide class of consumers who did not have an account with AT&T and received a call from the company during the last four years that used an artificial or prerecorded. 

AT&T invaded privacy of non-account holders, class action says

Rickard argues she suffered invasion of privacy, intrusion into her life, a private nuisance and was forced to spend time attempting to get the calls and pre-recorded voice messages from AT&T to stop. 

“Plaintiff suffered actual harm as a result (of) Defendant’s subject calls,” the AT&T class action claims. 

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of damages for herself and all class members. 

In other recent news involving AT&T, the company earlier this year agreed to pay $13 million to put an end to an investigation by the Federal Communications Commission into a January 2023 data breach that affected nearly 9 million consumers.
