
AT&T class action lawsuit overview:

AT&T sends unsolicited text messages to consumers and continues to do so after an attempt to opt out as has been made, a new class action lawsuit alleges.
Plaintiff Jack Rockwell’s class action lawsuit claims AT&T, by failing to honor opt out requests, shows it engages in telemarketing without the required policies, procedures and training of its personnel.
“Defendant’s refusal to honor Plaintiff’s opt-out requests demonstrates that Defendant has not instituted procedures for maintaining a list of persons who request not to receive text messages from Defendant,” the AT&T class action says.
Rockwell wants to represent a nationwide class of consumers who, after requesting to opt out, received two or more marketing text messages to their cell phone number from or on behalf of AT&T within any 12-month period in the last four years.
AT&T text messages caused aggravation, inconvenience, class action claims
Rockwell argues AT&T’s text messages caused himself and other consumers inconvenience, aggravation and annoyance, and constituted an invasion of privacy and violated their statutory privacy rights.
The class action lawsuit further claims AT&T is violating the Telephone Consumer Protection Act (TCPA) with its alleged “refusal to honor” opt-out requests.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for himself and all class members.
A consumer filed a similar class action lawsuit against AT&T last year over claims it violated the TCPA by placing telemarketing calls using an artificial or pre-recorded voice to non-account holders who had not provided express consent.
