Atrium Medical Corporation is facing a growing multidistrict litigation (MDL) consisting of claims describing various hernia mesh problems. One of the most recent injury claims comes from a Kentucky woman, alleging the company’s C-QUR Mesh V-Patch caused her to develop serious hernia mesh problems.
Plaintiff Renee T. is filing legal action against Atrium Medical Corporation, alleging the company failed to warn her against potential hernia mesh problems. According to the hernia mesh lawsuit, Renee had the C-QUR Mesh V-Patch implanted on July 5, 2011 for typical treatment purposes.
Renee opted to have the medical device implemented for hernia treatment after discussing the option with her physician and going over the company’s marketing materials. At all times relevant, Renee says she used the C-QUR Mesh V-Patch for its intended purpose and did not deviate from recovery instructions.
Even with this diligence, Renee allegedly experienced a multitude of hernia mesh problems that on balance worsened her medical condition. Renee opted to join the growing MDL against Atrium Medical Corporation after learning numerous other patients experienced similar hernia mesh problems.
Overview of Hernia Mesh Problems
Hernia mesh problems often reported by patients include infection and symptoms of biological rejection, in which the body has adverse reactions to the hernia mesh materials. Problems like these have been reported in conjunction with use of the Atrium C-QUR mesh products, allegedly due to an omega-3 fatty acid coating around the hernia mesh.
Patients say this component can potentially cause an adverse reaction from the body’s immune system, with patients developing flu like symptoms and mesh infection.
Hernia mesh is made from a polypropylene material, which is designed to provoke inflammation in the body. By doing this, the tissue surrounding the mesh will bond together and resolve the hernia. While the inflammation is supposed to resolve itself, prolonged inflammation could lead to a number of hernia mesh problems including abdominal pain, tenderness, and infection.
Early signs of hernia mesh failure may include signs of infection around the incision site, as well as heat radiating from the area. It is important to note that hernia mesh infections may lead to the development of biofilms, which are organized colonies of bacteria that are generally immune to antibiotics. In many cases of these hernia mesh problems, patients are forced to undergo revision surgery to resolve them.
Renee is filing her hernia mesh lawsuit in MDL No. 2753, where it will stand alongside other claims alleging similar injuries. By joining an MDL, Renee’s hernia mesh lawsuit will be streamlined through the litigation process and will avoid issues like conflicting rulings from different judges.
The hernia mesh problems listed in her lawsuit consist of pain and suffering, emotional distress, and loss of consortium. Renee ultimately alleges Atrium Medical Corporation either knew or should have known about the potential hernia mesh problems associated with their product, and failed to adequately warn her against them.
Renee states she would not have had the C-QUR Mesh V-Patch implanted if she had known the potential hernia mesh problems associated with the device.
