Atrium Medical Corp., manufacturers of the C-Qur Mesh V-Patch, faces an abdominal mesh complications lawsuit by a woman joining the growing multidistrict litigation (MDL) against the company.
Plaintiff Amanda M. files the abdominal mesh complications lawsuit in New Hampshire federal court. The lawsuit was filed on March 14, 2018.
According to the abdominal mesh complications lawsuit, Amanda says that she, a resident of the state of Virginia, was implanted with the C-Qur Mesh on Sept. 24, 2015, at Stafford Hospital Center. However, because of severe adverse effects and complications, she had the C-Qur Mesh removed on April 7, 2016, less than a year later.
Amanda says that some of the adverse effects she experienced included a “recurrent hernia requiring placement of new mesh for repair, omental adhesions, mesh contraction, [and] pain.”
The abdominal mesh complications lawsuit was filed on multiple counts, including negligence, design defect, manufacturing defect, failure to warn, defective product, breach of express warranty, breach of implied warranty, fraudulent concealment, constructive fraud, negligent misrepresentation, negligent infliction of emotional distress, gross negligence, and unjust enrichment.
Amanda demands a trial by jury.
Overview: Abdominal Mesh Complications
Pending lawsuits against the Atrium Medical Group have been consolidated into an MDL in federal court alleging the C-Qur Mesh causes patients to suffer severe adverse effects such as adhesion, autoimmune reactions to the mesh, mesh migration and rejection, and bowel perforation.
According to the U.S. Food and Drug Administration (FDA), a hernia occurs when a muscle or connective tissue is pushed through by an organ. It can be caused by a variety of different conditions and activities such as coughing or sneezing a lot, obesity, diarrhea, constipation, and the lifting of heavy objects. An increase of pressure on the abdomen can lead to a hernia, which often occurs at the abdominal wall.
Most common types of hernias include those occurring at the abdominal/ventral wall, at the inner groin known as an inguinal hernia, at an incision made in the abdomen known as an incisional hernia, at the naval called an umbilical hernia, and inside the abdomen known as a hiatal hernia.
Plaintiffs claim the materials making Atrium’s C-Qur mesh are causing severe adverse effects. The C-Qur mesh is composed with a polypropylene coating made of Omega-3 oil. The purpose of the coating is to prevent the mesh from attaching to the body’s tissues, but lawsuits claim that this does not always happen.
Some additional complications reported with use of the mesh have included sepsis, bowel obstruction, peritonitis, abscesses, puncture of organs of the abdomen, lack of mesh ingrowth, and wall tears.
Allegations against the company also purport that because the product was approved by the FDA’s 510(k) program, a fast-track approval system, it allowed the C-Qur mesh to circumvent premarket studies.
In July 2013, Atrium issued a Class 2 recall due to increased infections risks associated with the C-Qur mesh.
The Abdominal Mesh Complications Lawsuit is Case No. 1:18-cv-00216, in the U.S. District Court for the District of New Hampshire. The Hernia Mesh MDL is In re: Atrium Medical Corp., C-Qur Mesh Products Liability Litigation, MDL No. 2753, in the aforementioned U.S. District Court.
