An asbestos mesothelioma lawsuit recently filed in federal court blames talcum powder use for the fatal exposure.
The asbestos lung cancer lawsuit was filed against the Colgate-Palmolive Company, Footlocker Inc, among others. According to the lawsuit, the defendants caused one of the now deceased plaintiffs, Esther H., to develop mesothelioma.
The asbestos lawsuit is brought by Gilbert H. individually and on behalf of the estate of Esther H., along with Rose T. and Richard H. The lawsuit alleges that Esther was wrongfully exposed to asbestos fibers and asbestos-containing products.
Her exposure to the toxic substance was alleged through her daily use of Cashmere Boquet talcum powder products. The lawsuit says she breathed in the fibers from 1954 into the 1970s.
Esther reportedly purchased these products at Woolworths (now Footlocker) and the products were manufactured and marketed by the defendants during the relative time periods. Esther was first diagnosed with mesothelioma in August 2014.
After being diagnosed, Esther was required to receive extensive medical treatment and endured great physical pain and suffering, disfigurement, mental anguish and emotional pain and suffering until her death, according to the lawsuit.
Esther died in November 2014. The surviving members of her family joined the lawsuit and have attached claims for the pain and suffering they say they must endure due to the loss of Esther.
Esther’s mesothelioma lawsuit asserts claims for negligence, strict product liability, conspiracy, breach of warranty, and fraudulent conduct, malice and gross negligence. The asbestos mesothelomia lawsuit asks that the defendants pay compensatory damages and punitive damages.
