A South Carolina widow claims that her late husband’s company negligently caused his death, and subsequently filed an asbestos employment lawsuit
The asbestos employment lawsuit against CSX Transportation Inc. was filed by Rutha F. after her husband, Marvin F., died of asbestos related injuries.
CSX Transportation Inc. is a railroad company for which Marvin F. worked. According to the asbestos employment lawsuit, the company acted negligently, failing to take sufficient measure to prevent asbestos-related injuries in their employees.
Specifically, the lawsuit claims that CSX Transportation negligently failed to provide a safe place for Marvin F. to work that would protect him from asbestos-containing materials.
Instead, Marvin was exposed to dangerous asbestos-containing materials while working for CSX Transportation, the asbestos employment lawsuit claims, leading to his stomach cancer and colon cancer diagnoses. Marvin’s cancer led to his death on November 4, 2014.
Marvin developed stomach cancer due to this asbestos exposure, the lawsuit claims, which spread to other parts of his body, leading to colon cancer. Marvin died of these injuries.
According to the asbestos employment lawsuit, Rutha holds CSX Transportation responsible for her husband’s death for failing to provide safe space and equipment to protect employees like Marvin from dangerous asbestos fibers.
The lawsuit further claims that the company failed to provide employees with warnings about the dangers of asbestos or instructions on how to safety use asbestos-containing product
What is Asbestos?
Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses. Asbestos has been classified as a known human carcinogen, or substance that is known to cause cancer in humans.
Asbestos’ microscopic fibers can accumulate in the lungs and cause several critical health problems, the worst of which is cancer. Asbestos cancers, including lung, stomach, colon, and others, can in some cases take years or even decades to develop. However, these cancers can also spread rapidly to distant organs of the body.
Because of these factors, asbestos cancers are commonly diagnosed at a late stage of development, which is more dangerous and difficult to treat.
Filing an Asbestos Employment Lawsuit
In most cases, asbestos lawsuits are filed by workers who have been exposed to asbestos in their line of work. For some, continuous exposure to asbestos led to their cancer diagnosis, while for others, it only took a single instance.
According to many asbestos employment lawsuits, the companies that allow their workers to be exposed to asbestos should have been aware of the dangerous nature of their asbestos-containing materials.
Companies should also be aware of asbestos’ ability to cause disease and even fatalities and take precautions against such dangers. There are many asbestos regulations in place to prevent these kinds of issues. Asbestos exposure reported to health regulators is taken very seriously.
Many people exposed to asbestos have filed asbestos employment lawsuits after being diagnosed, which can help with medical expenses and other financial losses.
If you or someone you know has been diagnosed with or died from an asbestos related disease such as asbestos lung cancer, you may be able to file an asbestos employment lawsuit or seek an asbestos fine
