A deceased maintenance worker’s family is pursuing an asbestos cancer lawsuit he originally filed before his death, hoping to gain compensation of up to $15 million from the company they claim was liable for his death.

According to the asbestos cancer lawsuit, Dennis S. was exposed to asbestos while working at a Celanese Corp. plant. The asbestos exposure came from asbestos-containing gaskets manufactured by John Crane Inc. from 1971 to 1980.

Dennis died of mesothelioma cancer decades after his alleged exposure to asbestos, and his family claims that Celanese and John Crane are responsible for his death, having failed to adequately warn him about the deadly and hazardous nature of the material.

The asbestos cancer lawsuit claims that the company was aware of the dangerous, asbestos-containing materials prior to Dennis working there, even decades beforehand. The company was also aware that asbestos was not only present in the equipment, but was capable of causing disease and subsequently killing people.

Despite the company’s knowledge of the harmful material in their facilities and the potential threat it posed to workers, Dennis did not know about the dangers of asbestos. The asbestos lung cancer lawsuit alleges that the companies involved never warned him about potential asbestos exposure.

A month after he was diagnosed with mesothelioma in August 2013, Seay filed the asbestos cancer lawsuit. Seay died in December 2014 before seeing the lawsuit through.

Asbestos Cancer Lawsuit

According to evidence provided to jurors, the disease was aggressive and fast-working.

Dennis’s former employer, Celanese, has responded to the asbestos cancer lawsuit by blaming Dennis’s death on another company. According to Celanese’s attorney, Celanese hired Daniel Construction Co., which then employed Dennis. Based on this evidence, the company claims that Daniel Construction was responsible for Dennis’s asbestos cancer, not Celanese.

Celanese itself manufactured polyester resin and fiber, and did not make asbestos-containing products. According to the company, the asbestos-containing products that exposed Dennis to asbestos and resulted in his mesothelioma cancer diagnosis were provided by Daniel Construction.

“We assumed because of what they told us and what they signed, that Daniel [Construction] would provide a safe workplace for all Daniel [Construction] employees, including [Dennis],” the attorney said.

Mesothelioma is a cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos. Asbestos lung cancer takes decades to develop, but quickly spreads to distant organs. Because of these factors, asbestos lung cancer is commonly diagnosed at a late stage of development.

Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses. Asbestos’ microscopic fibers can accumulate in the lungs and cause several critical health problems, the worst of which is lung cancer.
