Apple discrimination class action lawsuit overview: 

  • Who: Plaintiffs Justina Jong and Amina Salgado filed a class action lawsuit against Apple Inc. 
  • Why: Jong and Salgado claim Apple discriminates against its female employees by paying them less than their male co-workers who perform “substantially similar” work. 
  • Where: The class action lawsuit was filed in the Superior Court of the State of California, County of San Francisco. 

A new class action lawsuit alleges that Apple discriminates against its female employees by systematically paying them lower wages than their male counterparts. 

Plaintiffs Justina Jong and Amina Salgado’s class action lawsuit claims Apple pays its female workers lower rates than male employees performing “substantially similar” work under similar working conditions. 

“Apple’s failure to pay women and men equal wages for performing substantially similar work is not justified by any lawful reason,” the Apple class action says. 

Jong and Salgado, both currently employed by Apple, want to represent a class of women who were employed by Apple in California in its Engineering, AppleCare and Marketing divisions at any time in the past four years. 

Apple’s performance evaluation system biased against female workers, class action claims

Jong and Salgado argue Apple, among other ways, discriminates against women by using a biased performance evaluation system that rewards men for the same behaviors women are penalized for in categories such as teamwork and leadership. 

“Because performance evaluation scores have a relationship to bonuses, Restricted Stock Units (RSUs), and pay increases at Apple, Apple’s biased performance evaluation system has a disparate impact on women,” the Apple class action says. 

Jong and Salgado claim Apple is guilty of violating the California Equal Pay Act, the California Fair Employment and Housing Act and California’s Unfair Competition Law

The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of liquidated damages for themselves and all class members. 

Multiple lawsuits have been filed against Apple recently by consumers, the government and state attorneys general over claims revolving around monopolistic actions the company is alleged to have committed.
