Apple iPhone charger class action lawsuit overview:

  • Why: Steines claims Apple misleads consumers by not including a charger with the sale of a new iPhone device. 
  • Where: The class action lawsuit was filed in Illinois federal court. 

Apple misleads consumers by not including a charger with the purchase of a new iPhone, a new class action lawsuit alleges. 

Plaintiff Elizabeth Steines claims Apple began selling iPhones without the charger last year. Apple’s failure to include a charger with a new iPhone sale is not adequately disclosed to consumers, who are left unaware they purchased “an incomplete Product, devoid of essential functionality,” according to the Apple class action. 

Apple only discloses in small print on the back of the iPhone product’s box that the iPhone Lighting Cable, power adapter and headphones are sold separately, the Apple class action states. 

Steines argues that, by selling the iPhone without a charger, the product is “not adequate for its intended use, which was to function as a phone and mini-computer, because it requires power or energy to operate.” 

Steines claims further that consumers who buy a new iPhone and don’t already own a charger are forced to spend more money to purchase one, ultimately increasing the price of the product, according to the lawsuit.

“When Defendant removed the charger, not only was the price of the Product not correspondingly reduced by the amount of the power adapter, the price increased, unrelated to other added functionality which could justify this increase,” the Apple class action states. 

Apple claims environment as reason to not include iPhone charger with purchase

Apple claims its decision not to include a charger with an iPhone purchase is environmental, according to the Apple class action. 

Steines argues, however, that Apple “could have taken other measures to promote environmental sustainability” instead of allegedly “rendering the Product non-functional unless an additional purchase was made.” 

Apple is accused of unjust enrichment, fraud, negligent misrepresentation and breach of contract, as well as violating the Magnuson Moss Warranty Act, several state consumer fraud acts and the Illinois Consumer Fraud and Deceptive Business Practices Act

Steines demands a jury trial and requests declaratory and injunctive relief along with an award of monetary, statutory and/or punitive damages for herself and all class members. 

She wants to represent an Illinois class and multistate consumer fraud class of individuals who have purchased a new iPhone during the statute of limitations for each alleged cause of action. 

Consumers filed a separate class action lawsuit against Apple earlier this month, arguing the company ignored privacy advocates by releasing AirTag devices that can be used by stalkers and abusers to track their victims.

    No cord no charger on a iPhone 13 . Now Tmobile was with sprint and let’s say I had a perfectly paid off working iPhone 7s and they told me it will not be compatible with the new towers 5g so I they were offering iPhone 12 free and not one could be found as in the associate looked all over, so why are they going to offer an iPhone 12 when they don’t have none in stock and that’s the one you’re offering for free so I end up having to get an iPhone 13 which I’m still paying on it till this day did not come with a charger did not come with the cord. Within about 5 to 6 months the cord stopped working and I refuse to buy a new one and things ain’t cheap when you’re already paying over $1000 for a phone pack. My mortgage payment is only $336 my car payments only $147 And I’m paying more for one phone a month than I am for my car payment so it’s like is it a need no it’s not a need it’s just Sprint/T-Mobile got a lot of people that are suing them because of this. Yeah I wanna jump on the gravy train, but the only thing is when all these people go in and do all this. What are you gonna get out of it a buck 50 if too many people claimant then your settlement goes down unless you do a settlement on your own then you get a big pay . Just like data breach your information is got out there in the cyber world and you’re going to tell me that you get a check for $26 and some change but your name your information is still in cyberspace, so was it worth it? You’re not collecting a big chump change of this and what they’re doing the lawyers get a big chunk of it a big chunk when you get the chop change it’s leftover so you’re not gaining anything people the lawyers are talking in this money not you

    I purchased 2 iPhone 14 for my kids and the store never mentioned that there was no chargers. So I had to buy separate. These phones are getting ridiculous in price and the chargers should be included.
