Apple iPhone charger class action lawsuit overview:ย

Apple misleads consumers by not including a charger with the purchase of a new iPhone, a new class action lawsuit alleges.ย 

Plaintiff Elizabeth Steines claims Apple began selling iPhones without the charger last year. Appleโ€™s failure to include a charger with a new iPhone sale is not adequately disclosed to consumers, who are left unaware they purchased โ€œan incomplete Product, devoid of essential functionality,โ€ according to the Apple class action.ย 

Apple only discloses in small print on the back of the iPhone productโ€™s box that the iPhone Lighting Cable, power adapter and headphones are sold separately, the Apple class action states.ย 

Steines argues that, by selling the iPhone without a charger, the product is โ€œnot adequate for its intended use, which was to function as a phone and mini-computer, because it requires power or energy to operate.โ€ย 

Steines claims further that consumers who buy a new iPhone and donโ€™t already own a charger are forced to spend more money to purchase one, ultimately increasing the price of the product, according to the lawsuit.

โ€œWhen Defendant removed the charger, not only was the price of the Product not correspondingly reduced by the amount of the power adapter, the price increased, unrelated to other added functionality which could justify this increase,โ€ the Apple class action states.ย 

Apple claims environment as reason to not include iPhone charger with purchase

Apple claims its decision not to include a charger with an iPhone purchase is environmental, according to the Apple class action.ย 

Steines argues, however, that Apple โ€œcould have taken other measures to promote environmental sustainabilityโ€ instead of allegedly โ€œrendering the Product non-functional unless an additional purchase was made.โ€ย 

Apple is accused of unjust enrichment, fraud, negligent misrepresentation and breach of contract, as well as violating the Magnuson Moss Warranty Act, several state consumer fraud acts and the Illinois Consumer Fraud and Deceptive Business Practices Act.ย 

Steines demands a jury trial and requests declaratory and injunctive relief along with an award of monetary, statutory and/or punitive damages for herself and all class members.ย 

She wants to represent an Illinois class and multistate consumer fraud class of individuals who have purchased a new iPhone during the statute of limitations for each alleged cause of action.ย 

Consumers filed a separate class action lawsuit against Apple earlier this month, arguing the company ignored privacy advocates by releasing AirTag devices that can be used by stalkers and abusers to track their victims.ย

    My family just got new clothes phones and damm did I wish I knew about the blocks and chargers before. I always like to have an extra charger. So 2 blocks an one charger costed me over 100 bucks itโ€™s insane

    I commented above I apologize I forgot to say add me to the lawsuit please this is so misleading Iโ€™m a single mom with a special needs son and Iโ€™m taking care of my mother on hospice. We had an emergency situation and my phone died and I had absolutely no way to call anybody for help. This is ridiculous. The phone was dead when I opened it itโ€™s crap I do not like this. I have the iPhone 13 I think 12 or 13. Thank you

    I would love to talk to an attorney about this I am livid. I was misled about the stupid iPhone. I have been a android user and I shouldโ€™ve never changed the fact that I have been stuck in a very dangerous situation taking care of my mother on hospice and did not understand or because Iโ€™m not familiar with the Apple crap but I need a break. I thought it came with one. I didnโ€™t even understand Iโ€™m sitting here wondering what the hell Iโ€™m gonna put this all in needing my phone and it died in an emergency. I want to sue the pants off of them. This is ridiculous and they charge us more and they donโ€™t even like drop the price. Itโ€™s not worth it I hate iPhone. I hate Apple. Iโ€™m done please. Somebody help me.

    Same here. I purchased the 13 pro max, didnโ€™t receive the block piece to the charger (cord) or headphones. I had to find an old charger and then go purchase the fast charger piece (the block that goes in the wall). More money spent. I just donโ€™t get it. I had my rant when I first purchased this phone and opened the box. They need to give us the correct items. My phone was dead when I took it out the box. Smh..

    i purchased two iphones 12 pro max in september 2021 and both purchases were incomplete i had to buy a charger for both phones, they give you the wire but not the box to charge it. i was mislead, i was deceived and i believe thats against the consumers protection act.

    Same upgraded my wife an my phones a year ago the new one cam e with the cord but our old blocks was a different style that wasnโ€™t included so we bought one of the new ones only cause of how expensive they was we still just have the one block

    I got my first iPhone in February and mine also did not come with a charger block, i do have a few chargers at home, and was aware of this no block issue because I watch YouTube vids a lot, some also say that using a charger not branded by Apple can ruin your iPhone, so I got a new one, but still not an Apple charger.
