A Michigan man has added his own DePuy hip replacement lawsuit to the litigation piling up against DePuy Orthopaedics over its allegedly defective Pinnacle implant. Plaintiffs in these lawsuits claim that, because of Pinnacle defects, they have suffered serious injuries.
The plaintiff, Robert W., notes in his DePuy hip replacement lawsuit that he was implanted with a Pinnacle Acetabular Cup System on May 19, 2008 in his right hip during a right total hip arthroplasty procedure. However, it wasn’t long after that initial surgery that Robert reports experiencing serious problems with the device, causing severe pain and discomfort in the surrounding area of his hip. The pain was debilitating enough that his mobility was affected, and he walked with a pronounced limp, the DePuy hip replacement lawsuit claims. These side effects have only worsened over time and are a direct and proximate result of being implanted with a DePuy hip implant, the DePuy hip replacement lawsuit alleges.
According to the DePuy hip replacement lawsuit, had DePuy given adequate warning about the complications linked with its device, Robert would have chosen a safer alternative and avoided these problems altogether. The DePuy hip replacement lawsuit, along with countless others like it, alleges that DePuy was aware of its product’s defects, yet continued to market the device as safe and effective, failing to warn consumers of these risks.
The July DePuy hip replacement lawsuit was filed on multiple counts, including negligence, manufacturing defect, design defect, inadequate warning, breach of express and implied warranties, negligent misrepresentation, fraud, and punitive damages.
Pinnacle Device Background
The Pinnacle Acetabular Cup System, or the Pinnacle device, was manufactured by DePuy Orthopaedics and released onto the market in 2001. Hip implants are used to replace hip joints damaged by a number of conditions.
The DePuy Pinnacle hip implant device is a popular hip implant option, widely used across the country. Indeed, according to DePuy, nearly 150,000 people have gone through a total hip replacement with this particular system. Unfortunately, this widespread usage of the DePuy Pinnacle hip implant means that any defects have the potential to affect a large number of patients.
The Pinnacle hip implant has been linked with a number of serious problems, including metallosis, toxicity, and a high rate of failure.
Thousands of lawsuits have so far been filed over serious problems with the DePuy Pinnacle device. Australia has already taken action over the reports of these problems, taking the DePuy Pinnacle hip implant off its medical market because of its high failure rate.
