Amtrak and the Southeastern Pennsylvania Transportation Authority (SEPTA) are facing a recently filed Amtrak personal injury claim.
The Amtrak personal injury claim comes from a Pennsylvania couple, with the husband alleging he sustained serious injuries from a fall that occurred from an uneven sidewalk in the SEPTA station in Villanova, Pa.
Plaintiff couple James Z. and Maria D. are filing this Amtrak personal injury claim together, alleging that SEPTA and Amtrak failed to regulate the state of their property to ensure that it was a safe environment for their staff and customers.
Because the railroad company failed to do this, the couple claims, an unmaintained sidewalk was allowed to become uneven and remain uncorrected. This allowed for the possibility of someone tripping and sustaining serious injuries in the SEPTA station, the couple says.
According to the Amtrak personal injury claim, James was heading to a platform in the station that was going to Philadelphia on May 17, 2017. During this time, James had reportedly tripped on an uneven sidewalk and sustained serious injuries.
The couple argues that Amtrak and SEPTA are responsible for maintaining a safe environment on each of their premises for customers and staff. This includes the SEPTA station in Villanova, in which the uneven sidewalk could cause injuries to other people, according to the couple’s Amtrak personal injury claim.

The Amtrak personal injury claim alleges the fall had caused James to experience a torn rotator cuff on his right shoulder, which required surgical treatment to repair the joint.
James says he also sustained serious injuries to his head, face, mouth, and teeth, which required extensive dental work. Furthermore, James has reportedly experienced severe shock to his nervous system, as well as mental anguish.
The Amtrak personal injury claim further alleges that the full extent of James’ injuries is not yet known, with other underlying injuries that have not yet presented themselves. During all times relevant, James says he has received medical treatment for all his injuries in Pennsylvania and will most likely continue to experience a diminished quality of life.
