Many Americans have become used to receiving unwanted solicitation through phone calls or text messages, such as the unwanted text messages some consumers have accused Amerigroup Insurance of sending.
What many people don’t know, but should, is that there are rules protecting consumers from receiving these unwanted text messages and phone calls.
The Telephone Consumer Protection Act (TCPA) provides consumer protection by prohibiting unwanted telephonic communication.
While the TCPA has been around since 1991, some companies cannot seem to resist marketing efforts that use text spam that violates TCPA rules.
Consumers report that Amerigroup Insurance, which is a health care coverage company that works with patients using Medicaid and Medicare, is one of those companies.
Several people who are on Amerigroup insurance plans have recently come forward, claiming that Amerigroup insurance has sent them a variety of unwanted text messages.
Some of these text messages read things like: “This is Amerigroup Washington, Inc., your health plan. We’d like to text with you.” Another reads: “Amerigroup: Many people don’t know why they need to go to the doctor for a checkup when they’re not sick. To learn why, text WHY.”
Though the people who have come forward about unwanted Americgroup text messages are Amerigroup customers, this does not mean that they ever gave express consent to receive such messages.
Due to the Amerigroup text messages, the insurance company is currently being investigated to determine whether the company violated the TCPA.
Each individual violation of the TCPA may earn an injured consumer between $500 and $1,500 in damages.
The Telephone Consumer Protection Act
The TCPA has been around since 1991, when it was created to protect consumers from unwanted solicitation. At the time, the TCPA focused on phone calls or robocalls, but as technology has advanced, the TCPA has expanded to include text messages as well.
The Federal Communications Commission sets rules to enforce the TCPA. Those rules prohibit sending text messages to a wireless phone number if the messages are sent using an autodialer, if the consumer has not provided express consent to receive the calls, or if the consumer has placed that number on the national Do-Not-Call list.
The unwanted text messages from Amerigroup insurance or other companies are not only annoying, but for some consumers they are costly, depending on their phone plans.
The Better Business Bureau provides guidance for consumers tired of getting unwanted text messages. If you have received any of the following from Amerigroup insurance or another company, you may be able to file a complaint with the FCC:
- an unwanted text message from a company to your wireless device
- a solicitation on a device that has been registered on the national Do-Not-Call list
- an autodialed text message from a telecommunications company offering products or services.
If you would like to receive compensation for TCPA violations, it is important to keep a good record of any text messages or calls you believe to be in violation of the TCPA.
If you have received unwanted text messages or robocalls from Amerigroup insurance or another company without having given express consent for the contact, you may be able to receive compensation by filing a complaint with the FCC or filing a TCPA lawsuit.
