Amazon Warehouse Workers NJ Class Action Lawsuit Overview: 

  • Who: A former employee of lodged a class action lawsuit against Amazon.
  • Why: The former warehouse worker claims Amazon unlawfully requires its warehouse workers to spend time on security and health screenings that are unpaid.

A former Amazon employee who says the tech giant didn’t pay its warehouse workers for the time they spent doing security and health screenings is urging a judge to certify her class action lawsuit against the company.

In a motion filed Nov. 12 in a New Jersey federal court, plaintiff Jennifer Chiu says Amazon has violated the New Jersey wage and hour law by failing to pay her and other hourly fulfillment center employees for time they spend undergoing security screenings.

“Thousands of other individuals have shared [her] experience as hourly employees working in Defendant’s New Jersey fulfillment centers during the period from May 2016 through the present,” the lawsuit states.

Chiu says she worked at Amazon from Aug. 2016 through May 2020 for about 40 hours per week.

Amazon Requires Warehouse Workers To Undergo Security and Health Screenings While off the Clock

The complaint was originally filed in 2018, however when the COVID-19 pandemic hit, it was amended to add claims seeking pay for time spent unpaid doing temperature checks as well as security checks.

Chiu says employees are required to have bag checks and metal detector wand screenings after clocking out but before leaving the warehouse. 

Temperature screenings also happened before clocking in for work.

The lawsuit follows a similar class action complaint filed in Colorado, alleging Amazon requires its warehouse workers to perform off-the-clock work before and after they clock in for their shifts.

In that case, a former Amazon employee claims the company’s off-the-clock work policy is unlawful and deprives warehouse workers of receiving proper compensation, including for overtime.
