A new class action lawsuit alleges Mixbook falsely advertised discounts on its website to induce consumers to make purchases based on false information.
Plaintiff Christine Dumm claims Mixbook’s website created a false impression that its products’ regular prices were higher than they truly were by advertising steep discounts alongside a supposed end date of the discounts.
“Reasonable consumers reasonably interpret defendant’s advertisements to mean that if they buy now, they will be getting a discount from the prices that defendant usually charges for its products,” the Mixbook class action lawsuit says.
Dumm wants to represent a nationwide class of consumers who, within the applicable statute of limitations period, purchased one or more Mixbook products advertised at a discount on the company’s website. She also wants to represent a California subclass of consumers.
Mixbook allegedly misled consumers about discounts, regular prices
Dumm argues Mixbook continues to run the same discounts with a new expiration date immediately after each purportedly time-limited sale ends.
“Defendant’s purported regular prices were not the prevailing prices during the 90 days immediately preceding defendant’s advertisement of the purported discounts,” the Mixbook class action lawsuit says.
Dumm claims Mixbook’s false advertisements harm consumers by inducing them to make purchases based on false information and artificially increasing consumer demand for the company’s products.
“As a result, defendant can charge a price premium for its products, that it would not be able to charge absent the misrepresentations described above,” the Mixbook class action lawsuit explains.
Dumm claims Mixbook is guilty of breach of contract, breach of express warranty, unjust enrichment, negligent misrepresentation, intentional misrepresentation and violations of California’s False Advertising Law, Consumers Legal Remedies Act and Unfair Competition Law.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of damages for herself and all class members.
In related news, Wayfair recently faced a class action lawsuit alleging it advertised fictitious regular prices and phantom discounts on its website.
