Allstate data collection class action lawsuit overview:

A new class action lawsuit alleges that Allstate Corp. and its subsidiaries illegally collected data on trillions of miles of consumers’ driving — and sold it to third parties.

A group of 25 plaintiffs filed the class action complaint against Allstate Corp., Allstate Insurance Co., Allstate Vehicle and Property Insurance Co., Arity LLC, Arity 875 LLC and Arity Services LLC on Feb. 5 in Illinois federal court.

According to the class action, Allstate conspired to covertly collect and sell huge amounts of consumers’ driving data and personal data, which included geolocation data, accelerometer data, magnetometer data, gyroscopic data, altitude, longitude, latitude, bearing, Global Positioning System (GPS) time, speed and accuracy.

The company allegedly collected this “driving behavior” data from both mobile devices and in-car devices, and used it to create individualized driver profiles based on driving habits and movement, the class action says.

Allstate created ‘world’s largest driving behavior database,’ lawsuit claims

The plaintiffs allege Allstate illegally collected this data without informing or seeking consent from millions of customers.

“Defendants were so effective that they created the ‘world’s largest driving behavior database,’ consisting of trillions of miles driven by over 45 million Americans,” the Allstate class action says.

The lawsuit claims Allstate profited from selling consumers’ driving and personal data to third parties, including other insurance carriers, and supporting its own insurance business.

The plaintiffs are suing on behalf of anyone in the United States whose data was collected by Allstate through the Arity software development kit (SDK). 

They allege Allstate and its subsidiaries have violated the Federal Wiretap Act, Stored Communications Act, Computer Fraud and Abuse Act and various state laws; the group seeks certification of the class action, fees, costs and a jury trial.

In 2024, Allstate agreed to pay $3.3 million to resolve claims it called consumers and recorded their calls without consent in violation of California’s Invasion of Privacy Act.

    I’ve had Allstate with drivewise. Their app sends false data and does not read correctly. Says excessive speeds when you drive the limit. Hard braking when coming to a stop. Total scam

    We have allstate and our premiums went up on house 2000. more a year. When we called and asked about it their response was “Oh we have a new policy that just came out to help”. We also had to call on our car insurance premium and they also said that too.
