A late Maryland woman’s alleged talc powder wrongful death has led to a representative of her estate filing a lawsuit against pharmaceutical giant Johnson & Johnson.
A personal representative of the estate of the injured plaintiff filed this lawsuit on behalf of Julia K., alleging she suffered from talc powder wrongful death as a result of Johnson & Johnson’s actions and inactions.
According to the lawsuit, the deceased began using Johnson & Johnson talc powder products in the 1970s and continued this use through the early 2000s. The lawsuit claims that Julia K. was diagnosed with injuries related to talc powder on March 24, 2009.
The talc powder wrongful death lawsuit also alleges injury, survivorship, economic loss and loss of services.
The talc powder wrongful death lawsuit was filed on multiple counts, including but not limited to failure to warn, defective manufacturing and design, breach of express and implied warranties, negligence, fraudulent concealment and wrongful death.
Talc Powder Basics
Consumers most often use baby powder to prevent diaper rashes in their young children, but the product is also used regularly by many adults. Adults use baby powder in their shoes, under the arms, and elsewhere as part of their personal hygiene routines.
Johnson & Johnson has encouraged, through its advertising, the use of its baby powder over the years as a personal hygiene product for women to use on their genitalia. Indeed, many women have regularly used these talcum baby powder products as part of their daily hygiene routine for years.
However, the product has been associated with talc powder injuries, including ovarian cancer and talc powder wrongful death.
Talc Powder Complications
According to talc powder lawsuits, studies have shown a substantial connection between talc-based baby powder and ovarian cancer. Ovarian cancer is a particularly dangerous form of cancer and affects thousands of women.
According to the Cancer Prevention Coalition, as many as 14,000 women die from ovarian cancer per year, the fifth leading cause of cancer fatalities for women in the United States.
Ovarian cancer is difficult to detect, and the survival rate for women with ovarian cancer is especially low. Once a patient has progressed into the later stages of cancer, there is not much that can be done to stop the disease, and it becomes much more dangerous.
Talc Powder Wrongful Death Lawsuits
Women involved in baby powder cancer lawsuits believe that companies that manufacture and market these baby powder products, including Johnson & Johnson, are responsible for providing adequate warnings of the risks involved in using their product.
Many choose to hire a baby powder injury attorney to make their lawsuit as effective as possible.
Plaintiffs claim that adequate knowledge of these potentially serious risks would have prevented them from using the product in the first place, and therefore would have allowed them to avoid ovarian cancer diagnosis altogether.
If you or someone you know has used Johnson’s Baby Powder or a similar powder product containing talc and have since been diagnosed with ovarian cancer, you may be able to file a baby powder cancer lawsuit.
If someone you love has suffered from talc powder wrongful death, you may be able to file a lawsuit on their behalf.
The Talc Powder Wrongful Death Lawsuit is Case No. 3:17-cv-00904, in the U.S. District Court for the District of New Jersey.
