An Align Probiotics class action lawsuit investigation is targeting Procter & Gamble over claims the mega-company falsely advertises the effectiveness of their probiotics products.
What are Probiotics?
Probiotics are live bacteria and yeasts that are good for digestive health. Probiotics refers to “good” or “helpful” bacteria that live in the gut and keep it healthy.
When a patient takes an antibiotic for other health-related issues, he or she looses helpful bacteria as well as the bacteria causing the infection. Probiotics help put the “good” bacteria back into the body.
There are different types of probiotics. Lactobacillus is found in yogurt and other fermented foods. Some lactobacillus can help with those who cannot digest lactose and can help with diarrhea.
Bifidobacterium, another type of probiotic, can also be found in dairy products and may help with irritable bowel syndrome (IBS).
Procter & Gamble claim they have created a new strain of bifidobacterium called Bifantis. Proctor & Gamble says that “Bifantis was developed by Gastroenterologists and, when taken daily, will help your body build and maintain a healthy digestive system.”
The makers of Align Probiotics say that their product does 3 things. It builds and maintains a healthy digestive system, it restores a natural digestive balance and it protects against digestive upsets.
Align Probiotics Class Action Lawsuit
However, some customers have accused Procter & Gamble of misleading consumers and making false claims about their product.
A couple years ago, an Align Probiotics class action lawsuit was filed by a group of customers. This Align Probiotics class action lawsuit stated that P&G marketed Align as being unique because of Bifantis.
They also say P&G claims that Align “brings peace to your digestive system.”
According to this Align Probiotics class action lawsuit, “Procter & Gamble has no support for these claims, even though it states that it does, going so far as to claim it has clinical proof. Procter & Gamble’s representations are false, misleading and reasonably likely to deceive the public.”
However, according to the Align Probiotics class action lawsuit, the “unique” ingredients in Align has never been substantiated, clinically or otherwise, and so P&G cannot legitimately make these claims.
The only real study Procter & Gamble references was actually funded by P&G and only dealt with IBS sufferers, even though the product was marketed to the general public.
The study found that no statistically significant differences were found between the placebo and Bifantis groups.
In a different study, also funded by Procter & Gamble, researchers from the University of North Carolina looked at almost 300 healthy individuals.
They found “no significant differences between the probiotic and the placebo groups in either abdominal discomfort or bloating.”
