Jewelry company Alex and Ani shared the customer data of its website visitors with TikTok without consent, a new class action lawsuit alleges.
Plaintiff Milan Hassid’s class action lawsuit claims Alex and Ani uses software on its website to collect visitor data and then shares said data with TikTok without first obtaining the express or implied consent of its customers.
“Defendant did not obtain Class Members’ express or implied consent to be subjected to data sharing with TikTok for the purposes of fingerprinting and de-anonymization,” the Alex and Ani class action says.
Hassid wants to represent a California class of consumers whose identifying information was sent to TikTok as a result of visiting the Alex and Ani website.
Alex and Ani shares visitors’ geographic, device and browser information, class action says
Hassid claims Alex and Ani uses the TikTok software to identify visitors by collecting data such as device and browser information, geographic information, referral tracking and URL tracking, as soon as a user lands on the website.
“The TikTok Software runs on virtually every page of Alex and Ani’s website, sending to TikTok images of every website user’s interest in Defendant’s services,” the Alex and Ani website class action says.
Hassid claims Alex and Ani’s use of the TikTok software violates the California Trap and Trace Law, which imposes civil liability and statutory damages for the installation of tracking software without a court order.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for himself and all class members.
A consumer filed a similar class action lawsuit against Gerber Products Co. last year over claims the company violated the California Trap and Trace Law by installing the TikTok tracking software on its website.
