A new class action lawsuit alleges Alcon Laboratories knew its eye drops were contaminated with fungus but did not disclose this information to consumers.
Plaintiff Kathy Even filed the class action complaint against Alcon Laboratories Inc. on Feb. 20 in a Colorado federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Alcon eye drops, specifically Systane Lubricant Eye Drops Ultra PF, Single Vials On-the-Go, 25 count, were contaminated with fungus, posing significant health risks to consumers.
The lawsuit claims Alcon was aware of the contamination but failed to inform consumers, leading to economic and personal injuries for those who purchased and used the product.
Alcon recalled the affected eye drops in December 2024, but the lawsuit alleges the company did not offer refunds to consumers who had already purchased the contaminated product.
Alcon eye drops recall notice warns of fungal contamination
Even says she purchased the Alcon eye drops while living in Colorado, relying on the product’s labeling claims that it was sterile.
She alleges she would not have bought the eye drops had she known they were contaminated with fungus, which can cause severe eye infections. Even says she suffered from red eyes, ocular swelling and itching, and discharge, requiring medical attention.
The lawsuit argues that fungal contamination in eye drops can occur due to failures in manufacturing processes, quality control, or packaging.
Alcon’s recall announcement did not specify the cause of the contamination, but the lawsuit alleges these issues were within the company’s control.
Even is looking to represent anyone in Colorado who purchased the recalled Alcon eye drops for personal use. She is suing for negligent misrepresentation, breach of express and implied warranty, unjust enrichment and violations of Colorado consumer law; she’s seeking certification of the class action, damages, fees, costs and a jury trial.

Still waiting for claim form, still won’t purchase systane products again…
On July 8, 2024, I went to a Retina Specialist for my annual eye exam. I was not told by the Eye Doctor nor his staff, there was a National Shortage on the eye drops, nor a different company, Alcon used. I felt stronger than usual Eye pain. Went home ill. Next morning I had pain and swelling in the artery outside my right eye about 2 inches in length. The next day same problem of pain, swelling of the artery 2 inches just outside of my left eye. Within in several days I had 2 arteries on my forehead, going into my hair swollen with bad pain. I went to the emergency, and they hospitalized me. They did over 50 test and a biopsy. I am still on a medication with no improvements in healing. I have been told if I stop this medication ” I will go blind.”
