Albertsons, Safeway class action overview:

  • Who: Plaintiff Michael Aaland has filed a class action lawsuit against Albertsons Companies Inc. and Safeway Inc.

A new class action lawsuit alleges Albertsons Companies Inc. and its subsidiary Safeway Inc. sent unsolicited text messages to consumers in Washington state.

Plaintiff Michael Aaland filed the class action complaint against Albertsons and Safeway on March 7 in a Washington state court, alleging violations of state consumer protection laws.

According to the lawsuit, Albertsons and Safeway sent Aaland an unsolicited text message in December 2024 advertising promotional sales from Safeway. Aaland claims he never consented to receiving text messages from Albertsons or Safeway.

Aaland says the text messages were sent for the commercial purpose of marketing Albertsons’ or Safeway’s products.

Albertsons, Safeway text messages violate state law, plaintiff claims

The lawsuit alleges the companies’ actions violate the Washington Consumer Electronic Mail Act (CEMA) and the Washington Consumer Protection Act (CPA).

Aaland seeks to represent a class of all Washington state residents who received a commercial electronic text message without prior express consent within the past four years.

The lawsuit claims Albertsons and Safeway’s actions were intentional and willful and that the companies are liable for damages to class members.

Aaland is seeking punitive damages on behalf of himself and the proposed class. He also seeks an order declaring the companies’ conduct to be illegal and an order requiring them to compensate class members for past and future losses resulting from the alleged unlawful practices.

This is not the first time Albertsons has been accused of sending unsolicited text messages. In February 2024, a class action lawsuit was filed in California alleging it sent text messages violating the Telephone Consumer Protection Act.
