Air France data breach class action overview:

  • Who: Two customers filed a class action lawsuit against Air France.
  • Why: They claim the airline company failed to prevent a data breach that compromised the personal information of thousands of customers.

A new nationwide class action lawsuit alleges Air France failed to prevent a data breach that compromised the personally identifiable information (PII) of thousands of current and former customers. 

Plaintiffs Ethan Allison and Arya Soofiani’s class action lawsuit claims Air France was unable to prevent cybercriminals from accessing its computer network and the highly sensitive personal information stored on it.

Allison and Soofiani argue that Air France’s failure to implement reasonable security safeguards or protocols to protect its customers’ personal information made it an “easy target” for cybercriminals.

“Defendant’s failure to timely report the data breach makes the victims vulnerable to identity theft without any warnings to monitor their financial accounts or credit reports to prevent unauthorized use of their PII,” the Air France class action lawsuit says.

Allison and Soofiani want to represent a nationwide class and California subclass of individuals residing in the United States and California, respectively, whose personal information was compromised in the Air France data breach.

Air France failed to adequately train employees on cybersecurity, class action claims

Allison and Soofiani argue that Air France failed to adequately train its employees on cybersecurity or to monitor its agents, contractors, vendors and suppliers in handling and securing the personal information of its customers.

“Plaintiffs and members of the proposed Class trusted Defendant with their PII. But Defendant betrayed that trust,” the Air France class action lawsuit says.

The plaintiffs claim Air France is guilty of negligence, negligence per se, breach of implied contract, unjust enrichment, invasion of privacy and breach of fiduciary duty, and of violating California’s Unfair Competition Law and the California Customer Records Act and Consumer Privacy Act.

They are demanding a jury trial and request declaratory and injunctive relief and an award of compensatory, exemplary, punitive and statutory damages for themselves and all class members.

So far this year, a number of airlines, including Delta, American Airlines and Alaska Airlines, have faced class action lawsuits, data breaches and fines.
