Seven plaintiffs filed an Actos lawsuit against Takeda Pharmaceuticals and Eli Lilly and Company claiming that Actos caused them to develop bladder cancer. The Actos bladder cancer lawsuit alleges that Takeda Pharmaceuticals failed to warn the medical community about Actos bladder cancer side effects.
Actos Bladder Cancer Overview
Type-2 diabetes is a life-long condition that can severely limit a person’s lifestyle. There are several medications that may be used to help manage the disease including Actos. Actos was approved by the U.S. Food and Drug Administration (FDA) in 1999. Since then, however, many patients allegedly developed Actos bladder cancer. The Actos lawsuit claims that this was a direct result from the “defective nature of Actos.”
Furthermore, Takeda Pharmaceuticals allegedly “concealed their knowledge that Actos can cause bladder cancer,” according to the Actos bladder cancer lawsuit. The lack of sufficient warnings about Actos side effects allegedly caused many patients to experience severe pain and suffering as a result of bladder cancer.
Actos bladder cancer has since become the subject of several studies. The FDA announced in 2010, after a review of Actos bladder cancer data, that “the risk of bladder cancer increases with increasing dose and duration of Actos use, reaching statistical significance after 24 months.”
Takeda Pharmaceuticals later recalled Actos from France but took no such actions in the United States. Many Americans allegedly developed Actos bladder cancer as a result, unaware that their type-2 diabetes medication may have been causing them to develop cancer.
Actos sales brought the defendants $4.8 billion worldwide. Countless individuals have used Actos for type-2 diabetes treatment and may have been put at risk for Actos bladder cancer.
Actos Lawsuit Specifics
Seven plaintiffs were named in this Actos lawsuit. Lead plaintiff Donald R. says he developed bladder cancer which caused him extreme pain and suffering. It was not until Jan. 2014 that he discovered his bladder cancer may have been an Actos side effect. Other named plaintiffs in the Actos lawsuit each allegedly experienced a similar story, each discovering the cause of their bladder cancer from using Actos in January 2014.
The plaintiffs allege that Takeda Pharmaceuticals failed to adequately warn users about Actos bladder cancer. Had Takeda been upfront about Actos side effects, they may not be facing the multiple Actos lawsuits and Actos MDLs which have been filed against them.
The Actos lawsuit was filed in early February. Claims include strict liability, failure to warn, negligent design defect, negligence, breach of warranty, and violation of consumer protection laws.
This Actos Lawsuit is Case No. 6:15-cv-00194, in the U.S. District Court for the Western District of Louisiana.
