Another Actos lawsuit was filed against Takeda Pharmaceuticals and Eli Lilly & Co. in late January, alleging that six plaintiffs from six different states developed bladder cancer as a side effect from their consumption of the type-2 diabetes medication.
Plaintiffs Patrick D. of California, Dolores D. of Wisconsin, Jerry G. of Tennessee, Richard H. of Missouri, James M. of Oklahoma, and Larry M. of Florida are all represented in this Actos bladder cancer lawsuit, which has been jointly filed in Louisiana federal court by these individuals, jointly with their spouses, or filed on behalf of a plaintiff who allegedlyย diedย from Actos bladder cancer condition.
Specifically, plaintiff Patrick, who took Actos to manage his type-2 diabetes from 2007 until 2011, allegedly developed bladder cancer and eventually died from this condition on Sept. 2, 2013. His family members filed this Actos bladder cancer wrongful death lawsuit on behalf of Patrick, alleging that Actos was the cause of his death.
Dolores and Jerry are individuals filing on behalf of themselves who took Actos from 2009 to 2013 and 2004 to 2011, respectively. Both allege that their bladder cancer diagnoses were directly caused by their use of the Actos type-2 diabetes medication.
Richard and his wife Margaret, James and his wife Vada, and Larry and his wife Dona have joined this Actos bladder cancer lawsuit as jointly filing couples, alleging that in addition to Richard, James, and Larry developing debilitating bladder cancer as a result of their ingestion of Actos, Margaret, Vada, and Dona have suffered loss of consortium from their spousesโ Actos bladder cancer condition.
Jointly, the six lead plaintiffs represented in this bladder cancer lawsuit allege several claims against Takeda and Lilly, including allegations of negligence, failure to warn, defective design, breach of express warranty, breach of implied warranty, loss of consortium, and wrongful death.
The Actos bladder cancer lawsuit seeks relief for these plaintiffs in the form of compensatory damages, punitive damages, exemplary damages, award of attorneysโ fees, cost of court proceedings, and any other forms of relief deemed fit by the court.
Actos Bladder Cancer Side Effects
Actos is a type-2 diabetes medication made and sold by Takeda and marketed by Eli Lilly. Since the late 1990s, Takeda has aggressively promoted their Actos drug throughout ย the United States, and with the help of Eli Lilly, Bayer has been able to do the same in the international diabetes drug market.
Over the last 20 years, Takeda and Lilly have earned billions of dollars in annual revenue from thousands of Actos consumers all over the world. However, Takeda and Lilly are facing thousands of legal battles as many consumers allege they developed bladder cancer after taking Actos.
In addition to the increased risk of bladder cancer, many Actos consumers have reported other side effects related to using the type-2 diabetes mellitus treatment. These Actos side effects can include:
- Chronic kidney disease
- Congestive heart failure
- Liver failure
- Lactic acidosis
- Bone fracture
- Rapid and excessive weight gain
- Difficulty breathing
- Edema (or fluid retention)
During the course of the Actos bladder cancer MDL, it was revealed that Takeda and Eli Lilly allegedly knew of the possibility of Actos bladder cancer since 2001, but did not warn their consumers.
