A class action lawsuit has been filed in Tennessee accusing Discover of using “slight-of-hand sales tactics” to “dupe unsuspecting individuals into unknowingly enrolling” in costly payment protection plans. The Discover class action comes nearly a week after the Minnesota Attorney General filed a similar lawsuit against Discover for the same deceptive business practices.
The Discover payment protection plan class action lawsuit accuses Discover of using confusing and misleading sales tactics to “surreptitiously enroll unwitting individuals” into costly payment protection plans. It also charges the company with further perpetrating their “deceptive scheme” with improper calculations of fees related to the plan and with their refusal to refund the “unlawful fees.”
“Upon information and belief, the Plan is aggressively promoted to individuals by Defendants’ sales agents via scripted telephone sales pitches, which occur during the enrollment process, subsequent solicitations, or even during client initiated inquiries,” the Discover class action lawsuit says. “In reality, however, Defendants’ agents use misleading, sleight-of-hand sales tactics to willfully and knowingly dupe unsuspecting individuals into unknowingly enrolling in the Plan.”
The Discover card class action lawsuit claims agents from the company often misrepresent their intentions during solicitations, stating that they are merely seeking authorization to send promotional materials relating to the payment protection plan. In actuality, however, when individuals agree to receive promotional materials, the agents “unilaterally extend the scope of that authority and enroll he individuals in the Plan without consent.”
The Discover payment protection plan class action lawsuit is brought on behalf of a proposed class of Tennessee citizens that were enrolled in the payment protection plan without their consent during the longest period permitted by the applicable statutes of limitations. It is seeking damages to class members, restitution of fees, and other relief.
