Bargain hunters who shopped at a Gap, Banana Republic Factory store may be able to participate in a $3.75 million settlement ending a class action lawsuit alleging the retail giant duped consumers with a false reference pricing scheme.

Class Members include those who purchased items either in-person or online from a Gap Outlet, Gap Factory Store, or Banana Republic Factory Store from May 24, 2010 through May 10, 2019.

A group of consumers from California, New Jersey, and Florida lodged the Gap, Banana Republic factory store class action lawsuit after being subject to an alleged false reference pricing scheme. According to the complaint, Gap and Banana Republic used fake reference prices to tout merchandise in their factory stores. The fake pricing reportedly included indications that items in the factory stores were sold at a much higher price at a regular retail location; however, the items were allegedly never offered for sale at such prices.

The Gap, Banana Republic factory store class action lawsuit contended that the retailer had the duplicitous scheme down to an exact formula they would use to generate the fake reference price. Unaware consumers would allegedly think that they were purchasing items on sale or at a discount that was entirely fictional. According to the Cap, Banana Republic factory store class action, the items would be advertised at a supposedly discounted price from the price they would be offered at in an action regular retail location.

In fact, alleged the plaintiffs, many of the items in Gap, Banana Republic factory store locations are manufactured and sold for the factory stores and are never offered for sale at retail Gap and Banana Republic locations.

The retailer refused to admit any wrongdoing, but agreed to resolve the claims by paying a $3.75 million Gap, Banana Republic Factory store class action settlement. Under the terms of the settlement, Class Members can claim up to $12 in settlement purchase certificates that can be used at any Gap or Banana Factory or Outlet store.

Class Members with proof that they purchased an item from any Gap, Banana Republic Factory store between May 24, 2010 and May 10, 2019 can claim up to $12 in settlement purchase certificates. Class Members without proof of purchase can claim one $6 certificate.

To make a claim in the Gap, Banana Republic Factory store class action settlement, Class Members must submit a claim online or by mail by Jan. 6, 2020.

Class Members who wish to opt out of or object to the class action settlement must do so by Sept. 23, 2019.

Who’s Eligible

Class Members include those who “made an in-store or online purchase from Gap Outlet, Gap Factory Store or Banana Republic Factory Store between May 24, 2010 and May 10, 2019 and have not received a refund or credit for all of [their] purchases.”

Potential Award

$6 to $12 store credit

Proof of Purchase

None required. Those with proof of purchase can claim up to two settlement purchase certificates.

    I filed my claim with supporting proof of purchase, in a timely manner, and never received an email with any voucher(s). My total purchases amounted to over $700, so I reached out to notify them and ask if they could re-send/re-issue these vouchers and received this response…

    “Per the terms of the Settlement Agreement and Court Orders, including the agreement between the parties to extend the deadline for vouchers to April 23, 2021, all vouchers issued under this settlement have expired and are no longer valid.

    Whereas the administration of the settlement is complete and the vouchers are no longer valid, no replacement vouchers may be issued”.
