AT&T Mobility Internet Tax Settlement

AT&T AT&T is the subject of yet another class action lawsuit settlement, this time over unlawfully charging fees for internet access through certain services, including iPhone data plans, Blackberry data plans, other smart phone data plans, laptop connect cards and pay-per-use data services. If you paid taxes, fees or surcharges to AT&T Mobility on internet access through one of these services within the past five years, you might be eligible to receive benefits from the class action settlement.

 

Plaintiffs in the AT&T Mobility class action lawsuit allege AT&T Mobility violated the Internet Tax Freedom Act and other state laws by tacking on charges for internet access. If you received a bill from AT&T Mobility between November 1, 2005 and September 7, 2010 that had charges for any of the following internet access services, you’re considered a member of the AT&T Mobility class action settlement class:

 

Data Connect Plans: Web access and ability to send and receive internet email through a computer equipped with a laptop data card.

 

Smart-phone Data Features “Bolt-on”: Web access and ability to send and receive internet email.

 

Smart-phone Standalone Data Plans: Web access and ability to send and receive internet email.

 

iPhone Data Plans: Web access and ability to send and receive internet email.

 

Personal Blackberry Plans: Web access and ability to send and receive internet email; also includes access to Blackberry APN, which provides push email, and contacts/calendar synchronization through RIM server.

 

Enterprise Smartphone Plans (using RIM/Blackberry, Goodlink or Microsoft application provider): Same as Personal Blackberry plans, and also provides enterprise customer’s end users the ability to send and receive internal and internet email to and from email addresses provided by the enterprise customer.

 

There are three main benefits you will receive as a class member of the AT&T Mobility settlement. First, AT&T Mobility will stop collecting taxes on internet access unless state laws change and permit or require them to do so. Second, AT&T Mobility will prepare and process tax refund claims seeking a refund of the internet taxes they collected from the class members and paid to the taxing jurisdictions. Third, AT&T Mobility will pay class members any vendor’s compensation they received, which is the amount of money AT&T Mobility was allowed to retain from the sales tax it collected as compensation for collecting the taxes for some taxing jurisdictions.

 

If you’re a member of the AT&T Mobility internet tax settlement class, you will not have to do anything to receive these benefits. You will automatically receive your tax and vendor’s compensation refund if the class action settlement is approved at the Final Fairness Hearing on March 10, 2011. If you wish to exclude yourself from the AT&T Mobility internet tax class action lawsuit settlement, however, you must submit your request for exclusion postmarked no later than February 2, 2011.

    Was dismayed to receive an $1800 AT&T Bill . Had been paying $70 per month, but was told due my internet text/>did not use. That had to pay a $700 bill. Told them cut it off . Told i would have to contact another office . So i cut it off and had that no# subcribed to and activated same day to Verizon. Phone worked on that billing to another party for two or three months. Verizon then billed an elaborate fee and I cut it off. Noted that my old no# now works here in Corsicana, Tx to a colored woman ??? Phone was stolen while in employ of Western Express . Same Co. that I had cancelled my A T & T service with . They (Co. ) stole my trck with phone inside ! Took truck while off duty ie Insurance was invalid> refused to drive , They had failed to mail the proper document ,ORIGINAL N wanted to fax me a copy > which was invalid if not original !!!
