An Alabama woman recently filed a lawsuit against Bayer Healthcare, alleging that she suffered from serious long term side effects of Essure birth control.
The plaintiff, Cara C., says she was implanted with the Essure birth control device, manufactured by pharmaceutical giant Bayer, on June 3, 2013. She then underwent an HSG test, which showed that her Essure birth control device was in place and functioning properly.
Unfortunately, shortly thereafter, Cara says she began suffering from unusual bleeding, pain, and cramping that would prove to be long term side effects of Essure. Because of these long term side effects of Essure, Cara says she has had to undergo further surgery and suffer further medical expenses.
After discovering these alleged problems with Essure, Cara and her husband Aaron turned to litigation. According to their lawsuit, Essure was associated with certain severe risks—including the long term side effects of Essure she suffered from—but the birth control devices were still marketed as safe, “surgery-free,” simple procedures.
Indeed, their lawsuit alleges that Bayer Healthcare either knew or should have known about the risks associated with its popular birth control device, yet failed to adequately warn the public and the medical community about the risk of long term side effects of Essure.
Cara filed her lawsuit over the long term side effects of Essure on Dec. 11, 2018, in the U.S. District Court for the Eastern District of Pennsylvania. The lawsuit was filed on multiple counts, including negligent training, risk management, breach of express warranty, negligent misrepresentation, and failure to warn. Cara’s husband Aaron also filed on one count of loss of consortium.

Basics of the Essure Device
The popular birth control device Essure, manufactured by Bayer Healthcare, has been around since its approval by the U.S. Food and Drug Administration (FDA) back in 2002. Since then, around 750,000 Essure devices have been implanted.
What is the Essure device? Essentially, this is a form of permanent birth control with two metal coils and a thin fabric lining. Essure is widely advertised as “surgery-free,” and is generally done in an outpatient procedure, after which it takes a few months for the tissue to grow in around the coils, blocking the fallopian tubes to prevent pregnancy.
Long term side effects of Essure are reportedly far more severe than patients are warned about. Indeed, patients have reported complications like device failure, migration, organ perforation, device fracture, and ectopic pregnancy, among several others. In some cases, serious Essure complications can require surgery to remove the device. Of course, removal surgery brings about the risk of further complications, as well as medical expenses.
Filing an Essure Lawsuit
