Ticketmaster Fee Class Action Lawsuit

Ticketmaster.comThousands of people who ordered tickets from Ticketmaster in the past 10 years will be receiving emails detailing a class action lawsuit against the company that challenges its fees. If you purchased tickets using Ticketmaster.com during the period from October 21, 1999 through May 31, 2010, you may be entitled to a fee refund if a Ticketmaster class action settlement is reached.

 

The Ticketmaster class action lawsuit alleges that Ticketmaster, a division of Live Nation Entertainment, mislead customers into believing that the company’s “Order Processing Fee” and “UPS Delivery” charge were passed-on fees, instead of profit generators.

 

There are two claims at issue in the Ticketmaster.com fee class action lawsuit:

 

In the Order Processing Fee Claim, plaintiffs allege that the Order Processing Fee is deceptive and leads customers to believe that it represents Ticketmaster’s costs to process their orders, when it actually has nothing to do with the costs of processing orders and is simply a way for Ticketmaster to generate profit.

 

In the UPS Delivery Claim, the plaintiffs allege that the UPS Delivery fee is deceptive because it leads consumers to believe that this fee is a pass-through of the fees that UPS charges to Ticketmaster, when in fact it is a substantial mark-up of the amount Ticketmaster actually pays to UPS. Customers who choose to have their tickets delivered via UPS are charged fees ranging from $14.50 to $25 per ticket delivery, while customers who have their tickets sent via regular mail did not incur a fee. According to the lead plaintiffs in the Ticketmaster class action, had they and other customers known that these UPS Delivery fees were strictly for Ticketmaster’s profit, they would have chosen a different delivery option.

 

If these claims prevail, plaintiffs in the Ticketmaster class action lawsuit will ask the Court to award appropriate relief, including requiring Ticketmaster to repay each class member any money that Ticketmaster has made as a result of any conduct found to be illegal.

 

All class members will automatically be included in the Ticketmaster fee class action settlement, if it’s approved. If you wish to exclude yourself from the class action, however, you must file a written request for exclusion with the Notice Administrator no later than November 8. 2010.
