A worker claims that exposure to asbestos on the job caused him to develop mesothelioma.
Plaintiffs Clifford F. and his wife Lynda F. claim that Clifford was exposed to CBS Corporation’s asbestos-based products during the course of his normal work between 1961 and 1993.
According to Clifford and Lynda, Clifford worked as an Engineer on various ships and submarines in the Royal Navy of Great Britain. Allegedly, he worked on the ships when they were docked for repairs in the United States, including in Florida around Cape Canaveral. According to the claim, this exposure to asbestos led to medical problems.
Clifford says that he was exposed to products that contained asbestos while he worked in engine rooms of the Royal Navy ships and submarines. He claims that he was exposed to asbestos while he was working with these materials and that his exposure to asbestos on the job caused him to delve mesothelioma later in life.
Clifford and Lynda aim to hold CBS Corporation accountable for Clifford’s injuries because allegedly, the company knew or should have known that asbestos was dangerous to human health, and knew or should have known that the products Clifford was required to work with contained asbestos. Allegedly, the company failed to warn him that they could be dangerous to his health.
Clifford says that the defendants failed to provide him with a safe work environment, and failed to inform him of the risks associated with his work. Allegedly, his exposure to asbestos occurred during normal and necessary parts of his work.
Clifford and Lynda also aim to hold Crane Co., Crane Pumps & Systems Inc., and Foster Wheeler Energy Group accountable for Clifford’s injuries, because these companies allegedly produced other asbestos-containing materials that Clifford worked around. The couple claims that these companies failed to warn Clifford that the products contained asbestos and were dangerous.
Clifford argues that the companies knew or should have known that asbestos was dangerous to human health, but continued to use asbestos-containing products nonetheless. He claims that as early as the 1920s, asbestos has been linked to health problems like lung cancer. He says that not long after, asbestos was linked to other types of cancer, including mesothelioma.
Up until the middle of the 20th century, asbestos was commonly used in building and construction materials because the long fibers of the naturally-occurring mineral made it strong and resistant to heat. However, in the middle of the 20th century, it became largely outlawed in new building materials because of the hazard it posed to human health.
Clifford and Lynda claim that the companies knew or should have known that asbestos was dangerous because there is significant research available that asbestos is dangerous. Allegedly, the companies failed to warn Clifford of the hazards to his health in the interest of increasing their profits since the exposure to asbestos caused mesothelioma.
The CBS Corporation Exposure to Asbestos Lawsuit is Case No. 0:18-cv-62844-JIC, in the Circuit Court of the 17th Judicial Circuit in and for Broward County, Florida.
