Those who signed up to sell Jeunesse skin care products as a part of an alleged multi-level marketing scheme may qualify for cash from a $2.5 million class action settlement.
A Florida man alleged in a Jeunesse class action lawsuit that he and others were duped into taking part in a scheme that prioritized the recruitment of other sales people over actual sales of skin care products and nutritional supplements.
The plaintiff claims that Jeunesse rigged the system against distributors, forcing them to pay for a “starter kit” to take part in the multi-level marketing scheme.
The Jeunesse class action states that ultimately the sales and profit promised by Jeunesse failed to materialize and distributors were left holding unsold and even expired products.
Jeunesse denies any wrongdoing under the terms of the Jeunesse class action settlement, but has agreed to pay Class Members who bought a starter kit in order to take part in the sale and distribution of the skin care products, but did not end up making any profit after purchase of the kit.
Class Members also include those who purchased Jeunesse products for resale, but failed to resell their inventory and had to throw it away.
Starter kit Class Members can receive a payment up to the amount of the starter kit, not including any sales or commissions.
Other Class Members can receive a payment of up to 50 percent of the purchase price of the products they discarded, along with a 90 percent refund of products they still have, but failed to sell.
Under the terms of the class action settlement, active distributors will have to resign to take part in a claim. Additionally, the period of time covered by the class action settlement is Jan. 1, 2010 through Sept. 13, 2018
The deadline for Class Members to exclude themselves or object to the Jeunesse class action settlement is Nov. 26, 2018.
Who’s Eligible
There are two groups of Class Members:
- Class Members include those who “purchased a Starter Kit with the intent to build a business as a Jeunesse distributor, and not just to be able to buy Jeunesse products at the distributor discount … then did not earn at least as much in sales commissions or product resale profits as [they]paid for the Starter Kit (which for most people was approximately $49).”
- Class Members also include those who “purchased one or more Jeunesse products from Jeunesse with the intent of reselling those products, but … were unsuccessful in reselling them, and [they] either still have those products in unopened condition or discarded them.”
Potential Award
Varies.
Class Members can get up to $49 for the Jeunesse Starter Kit they purchased. In addition, Class Members can get up to 50 percent of the price of products they discarded or 90 percent refund of unopened items.
Proof of Purchase
Class Member ID for online claims. Those claiming discarded products will have to provide information about the products. Class Members seeking a refund for return products will need to follow the procedures under the Jeunesse Extended Product Return Benefit.
Those who file a claim will be automatically resigned as a distributor and their Jeunesse distributor account will be closed.
