A mother and father filed a recent JUUL vape pen lawsuit on behalf of their 15-year-old child against the makers of the e-cigarettes over allegations that they contain almost “three times more nicotine than is necessary” to support adult smoker nicotine cravings.
The JUUL vape pen lawsuit was filed in the U.S. District Court for the Southern District of New York demanding a trial by jury. The lawsuit was filed on June 26, 2018.
According to the JUUL vap pen lawsuit, D.P. is a 15-year old high school freshman. The plaintiffs say he first tried e-cigarettes in September 2017 and became immediately addicted to nicotine.
Despite his parents’ extreme measure which included checking his son’s urine for nicotine regularly, depriving him of areas where he could smoke and even changing schools, they allege he continued to be severely addicted to nicotine.
According to the JUUL vape pen lawsuit, his nicotine addiction has “altered his brain physically and chemically, and has put him at risk for a lifetime of life-long health problems, to say nothing of the economic costs of nicotine addiction.”
The plaintiffs are both residents of Valley Cottage, N.Y. They say that their son is a talented jazz musician who likes to mountain bike and ski. He is also a member of the high school track team.
However, upon entering the school, he entered an environment in which e-cigarette smoking was very pervasive. It would be multiple times per day that he would be offered “hits” to smoke from an e-cigarette, say his parents.
Due to his addiction, it “had an extreme effect on his behavior,” the lawsuit reports. He became “withdrawn, anxious, highly irritable and prone to angry outbursts, “the lawsuit adds.
His parents began to take serious measures: taking him from the specialized high school and moving him to another school, removing his bedroom door, and requiring that he not be allowed to go to the bathroom unescorted while at school.
However, he says that his feelings of “urges” to return to e-cigarette use would “become so powerful that he is unable to avoid JUUling even though it subjects him to disciplinary measures at home and as school,” the JUUL vape pen lawsuit states.
The JUUL vape pen lawsuit was filed on multiple counts including defective design, manufacturing defect, product defect as the result of inadequate warning and negligent design and marketing.

Numerous of lawsuits have been filed by parents on behalf of their children against the makers of JUUL e-cigarettes. They argue that the nicotine delivery of the JUUL device is that it delivers nicotine to the bloodstream much faster. This thus increases addiction to nicotine.
The lawsuits claim, moreover, that JUUL markets to both the youth and adults its extremely addictive products without sufficient warnings for these risks. They also argue that the JUUL has been marketing specifically to the youth through advertisements and other social media outlets.
