A $1.2 million settlement has been reached in a class action lawsuit alleging that individuals in a New Jersey correctional facility were forced to undergo a strip search without reasonable suspicion.
Ocean County, Ocean County Department of Corrections, the Chief of Corrections of the Ocean County Department of Corrections, and the Warden of the Ocean County Jail have agreed to pay $1.2 million dollars to those affected by the alleged strip search policy.
Individuals eligible for this class action lawsuit settlement include those who were admitted into the Ocean County Correctional Facility between Nov. 28, 2005 and Dec. 28, 2007, and were subject to a strip search upon entry despite bring arrested on a non-indictable matter and with lack of reasonable suspicion.
Under the settlement, Class Members who submit a valid claim will be eligible to receive up to $300. There are an estimated 7,530 eligible Class Members in the Settlement Class.
The class action lawsuit settlement will pay also pay awards to the named plaintiffs as well as court costs and attorneys’ fees for class counsel. Richard Wright and April Wedding, the two named plaintiffs in the case, are entitled to $10,000 each ($20,000 between the two of them) as an award for their participation in the class action lawsuit. Class Counsel will be able to apply for up to $625,000 in court costs and attorneys’ fees to compensate them for their work throughout the course of the litigation.
Individuals who wish to exclude themselves from the strip search class action lawsuit settlement have until Dec. 15, 2018 to mail their exclusion request to the settlement administrator. A claim form is available to be printed, filled out, and mailed, but must be sent by the claim form deadline of Feb. 1, 2019. The final approval hearing is scheduled for Apr. 16, 2019.
Who’s Eligible
Class Members include “All persons who were admitted into the Ocean County Correctional Facility during the period between November 28, 2005 through December 28, 2007, after being arrested only on a non-indictable matter, such as a disorderly persons offense or violation, traffic infractions, civil matters or other non-indictable occurrences, and were subject to a strip search upon their entry into the Ocean County Correctional Facility in the absence of reasonable suspicion.”
