Consumers who made an online purchase from the popular retail video game store GameStop may be able to participate in a data breach class action settlement.

The GameStop data breach class action settlement ends claims that consumers’ financial information was compromised in a hack that hit the popular gaming store from August 2016 until February 2017.

The plaintiffs alleged that GameStop did not adequately protect financial information submitted by consumers during online purchases.

GameStop notified affected consumers about the breach allegedly affecting 1.3 million credit and debit card numbers in June 2017, according to the GameStop class action lawsuit.

Under the terms of the GameStop data breach class action settlement, the gaming company will pay Class Members up to $10,000 for out-of-pocket losses from the data breach.

Class Members can also claim up to $235 for expenses related to reversing fraudulent charges associated with the breach, including bank fees and long distance phone calls.

The GameStop class action settlement stipulates that Class Members must have made reasonable efforts to protect themselves from fraud and identity theft, such as signing up for a credit monitoring service.

The company admits no liability under the terms of the GameStop data breach class action settlement and the parties agreed, according to court documents, that settling the allegations would be in their best interests to avoid the expense, time, and unpredictability of continued litigation.

Class Members who wish to object to or exclude themselves from the GameStop data breach class action settlement must do so before Dec. 13, 2018.

The final hearing is scheduled for Dec. 19, 2018.

Who’s Eligible

Class Members include those “who used a credit, debit or other payment card to make (or attempt to make) a purchase on www.gamestop.com between August 10, 2016 and February 9, 2017.”

Potential Award

Up to $10,000 for out-of-pocket expenses that were linked to the data breach, such as fraudulent credit card charges.

Up to $235 for out-of-pocket expenses Class Members incurred to reverse fraudulent charges, such as bank fees.

Proof of Purchase

Supporting documentation of the expenses or out-of-pocket charges incurred must be submitted with the Claim Form.
