A $150,000 class action settlement is now open to consumers who purchased MGM gift cards at a Costco location and had inactivity fees deduced from the cards’ balance.
If you purchased an MGM gift card from Costco and were assessed an inactivity fee between Oct. 24, 2010 and July 31, 2018, you could get money from a class action settlement.
The Costco, MGM class action settlement resolves allegations that customers were not provided with disclosures about inactivity fees before purchasing the gift cards.
Plaintiff David Hanson filed the MGM, Costco class action lawsuit in 2016 after purchasing 140 gifts cards to use at the hotel and casino.
According to the MGM gift card class action lawsuit, Hanson and other Costco members were not fully informed about the inactivity fees as required by federal law.
The plaintiff claims he read the disclosure before purchasing the MGM gift card at Costco but was led to believe that “no inactivity fee would be assessed until the conclusion of an eighteen-month period of inactivity beginning on the date stated on each MGM Gift Card.”
However, the MGM, Costco gift card fees class action lawsuit states that neither company adequately addressed how often such fees would occur nor the date said fees would actually begin.
The MGM gift card fees class action settlement resolves both defendants of lawsuit allegations.
Class Members who who wish to object to its terms or want to be excluded from the settlement must do so in writing no later than Oct. 15, 2018.
Who’s Eligible
Class Members include all U.S. residents who bought an MGM gift card and were assessed an inactivity fee between Oct. 24, 2010 and July 31, 2018.
Potential Award
Those who file a timely and valid claim will receive an equal share of the $150,000 MGM gift card class action settlement fund after litigation costs are paid.
