Four unnamed women filed a new USC lawsuit back in May, alleging that they suffered from sexual assault, sexual harassment, and sexual battery at the hands of the school’s gynecologist, George Tyndall.
This adds to the growing pile of litigation now filed by around 300 women over this alleged sexual abuse by Tyndall. Along with Tyndall, lawsuits also name the University of Southern California as a defendant.
The women, who are referred to in the USC lawsuit as Jane Does 1 through 4, allege a number of different concerns about Tyndall’s actions in the examination room. Details of the alleged sexual assault are included below.
Specific Allegations of The USC Lawsuit
According to the USC lawsuit, “Tyndall forced plaintiff Jane Doe 3 to remove all of her clothes, then proceeded to grope her breasts with his ungloved hands, and digitally penetrate her vagina with two of his fingers. Even when plaintiff Jane Doe 3 told Tyndall that she was in pain and asked him to stop, Tyndall continued to digitally penetrate plaintiff Jane Doe 3.”
Another USC lawsuit filed over the issue, this time by named plaintiff Lucy C., alleges that the way Tyndall touched her was “very different” than the way gynecologists typically check their patients.
“Tyndall moved his fingers in and out of her vagina, saying he wanted to loosen up her vaginal muscles for the speculum,” Lucy alleges in her USC lawsuit. She “told Tyndall that was unnecessary, but he insisted the penetration and movement prevented discomfort. Tyndall’s conduct caused [her] significant distress, but she could not move at this point.”
These are, tragically, far from the first claims made against Tyndall at USC. The list of allegations against him—three decades’ worth of complaints and more than 400 calls to a USC hotline—include such sexual misconduct as inappropriate touching and penetration, suggestive remarks, and even photographing women’s genitals, all while they are in a vulnerable position as his patients. These accusations go back to the early 1990s.
During his time at USC, Tyndall examined more than 20,000 patients.
The Tyndall Settlement
Instead of being held accountable for his actions, Tyndall was allowed to “quietly resign,” and was paid a significant financial settlement in June 2017 in order to keep these incidents quiet, lawsuits claim.
According to one USC lawsuit, “USC did not contact law enforcement, the attorney general, or the medical licensing board. Nor did USC inform Tyndall’s patients. Because Tyndall threatened a lawsuit against USC, USC entered into a separation agreement with Tyndall.”
“It’s abundantly clear to anyone that USC should have acted swiftly to put an end to Dr. Tyndall’s inappropriate behavior, and an end to his license to practice, as soon as the school became aware in the 1990s,” said an attorney for one of the plaintiffs to AP News. “Instead, USC chose to cover up Dr. Tyndall’s actions, and even worse, USC allowed them to continue, perpetuating Dr. Tyndall’s protection.”
