EucoClean bed bug and lice killing products are falsely advertised as being all natural even though they contain synthetic and toxic ingredients, according to a class action lawsuit filed last week in New York federal court.

Plaintiff Qiu-Yun Zhang says EucoClean 3-in-1 Bed Bug Defense System and EucoClean Naturals Lice Away are products meant to control pest infestation.

The plaintiff took note of TV Brands Direct Inc. d/b/a Green Room Marketing’s representations about the all-natural, non-toxic properties of the bed bug and lice products, according to the EucoClean class action lawsuit.

The EucoClean pest control products are reportedly marketed as being non-toxic and safe for use around children and pets. The product websites and labels stress that the products are all natural and eco-friendly.

However, the website does not allow consumers to view the products’ ingredients and also does not disclose the name of the entity responsible for manufacturing and marketing the product, the EucoClean class action lawsuit says.

Although the website represents the products as being all natural and non-toxic, they actually contain alcohol ethoxylate, which is reportedly a synthetic chemical and toxic substance.

According to the EucoClean class action lawsuit, the National Products Association prohibits ethoxylated ingredients in personal care products from being designated as “natural,” and doing so allegedly violates New York law.

Zhang says she purchased the 3-in-1 bedbug product online after reviewing the defendant’s “all natural” representation. After using the product, she reviewed the label to assure herself that the products was actually all natural.

She says the label lists alcohol ethoxylate and cocamido propyl betaine as “natural ingredients” even though they are allegedly synthetic compounds with toxicity concerns.

The label of the EucoClean product states that the lice-cleaning product contains alcohol, allegedly to conceal the fact that it contains alcohol ethoxylate, the EucoClean class action lawsuit says.

Zhang claims the defendant highlights the inclusion of eucalyptus, a natural oil from Australia, as the product’s main ingredient and fails to mention alcohol ethoxylate in order to deceptively represent the product as all natural.

“Concealing a synthetic ingredient while highlighting a natural ingredient in an alleged ‘all natural’ product” constitutes a second deceptive act and practice under New York law.

Zhang also accuses the defendant of targeting the African American community by representing their national spokesperson as someone named “Dewayne Waide,” who promotes their lice-cleaning product.

“Initial research indicates that the only American citizen known as DeWayne Waide died in 1988, some 25 years prior to the promulgation of the subject marketing piece,” the EucoClean class action lawsuit says. “Consumers may believe, however, that the celebrated basketball player, Dwyane Wade, is Defendant’s spokesperson, recommending the Product.”

The EucoClean class action lawsuit asserts claims for violations of New York consumer protection laws. Zhang seeks to represent a Class of consumers in New York who purchased the EucoClean products during the applicable statute of limitations period.
