Woman Files Semi Truck Accident Lawsuit Due to Tractor-Trailer CollisionA Texas woman filed a semi truck accident lawsuit against Bark River Transit, Inc. as well as the company’s driver, alleging that they are responsible for a truck accident that caused her to suffer severe injuries.

Plaintiff Janet D., a citizen of Texas, filed the lawsuit in Texas federal court on Aug. 23, 2018.

According to the semi truck accident lawsuit, Janet says that around Sept. 28, 2017 she was driving her Chevrolet pick-up going southbound on Interstate 37 in Corpus Christi, Texas.

As she was driving, she says that the semi truck driver, Ira H., caused a collision to occur between her and the commercial tractor-trailer rig he was operating by failing to stay in the same single lane he was driving in. The collision resulted in her suffering a number of serious injuries, the lawsuit states.

The semi truck accident lawsuit accuses the driver of failing to exercise proper care in the operation of the tractor-trailer. According to the semi truck accident lawsuit, the driver failed to:

  • Keep a proper lookout in which an ordinary driver would have maintained under the similar circumstances.
  • Failed to stay in the same single lane and thus violated the Texas Transportation Code.
  • Failed to comply with State Department of Transportation (DOT) regulations along with federal regulations while operating the tractor-trailer.
  • Failing to “turn the vehicle” to stop the collision from occurring.

The semi truck accident lawsuit was filed on a count of gross negligence committed by the truck driver, along with negligence and negligent hiring on the part of Bark River.

Janet requests damages for injuries she suffered as a result of the collision and the defendant’s allegedly negligent conduct. She says that she suffered injuries that include “severe bodily injuries to her neck, back, and other parts of her body generally.”

She also says that her “injuries are permanent in nature and have had a serious effect” on her health and well-being. She hopes to obtain recoveries that can help cover her costs for medical care. Expenses were incurred to help her treatment for the injuries, and Janet says she reasonably predicts that she will incur and need future medical attention.
