Those who received unwanted, annoying text messages from 3 Day Blinds about their window coverings may be entitled to an estimated $45 under the terms of a class action settlement.

Plaintiffs accused 3 Day Blinds of violating the Telephone Consumer Protection Act (TCPA) when it sent unsolicited advertisements to consumers’ cell phones via text message between Oct. 27, 2013 and July 13, 2018.

In order to avoid the cost of litigation, the company agreed to end the litigation by paying $675,000. Additionally, 3 Day Blinds has also agreed to comply with the TCPA, although the company admits no wrongdoing.

The TCPA was enacted by Congress in 1991 to help curtail the use of telemarketing by companies to tout their products and services. The TCPA strictly limits the way in which companies can contact consumers using unsolicited phone calls, text messages, and faxed communications. Steep fines of up to $1,500 per violation can be assessed under the TCPA as well.

Approximately 120,000 people received unsolicited text messages from the company, according to settlement documents.

The deadline to opt out or object to the 3 Day Blinds class action settlement is Oct. 8, 2018.

Who’s Eligible

Class Members include those who “received at least one text message advertisement on their cellular phone from, on behalf of, or promoting 3 Day Blinds or its merchandise, and did not provide 3 Day Blinds their consent to receive such messages,” between Oct. 27, 2013, and July 13, 2018.

Potential Award

$45 (estimated).
