ExtenZe Class Action Lawsuit Settlement

A proposed $6 million settlement has been reached in a class action lawsuit against the manufacturer of “male enhancement” product ExtenZe. If you’ve purchased ExtenZe within the past five years, you may be able to receive a cash refund or free ExtenZe merchandise under the class action lawsuit settlement.

 

The ExtenZe class action lawsuit accuses Biotab Nutraceuticals, Inc. and several other defendants of making false claims in their advertising, promotion, marketing and labeling of ExtenZe. According to the ExtenZe class action, the defendants’ claims that ExtenZe will increase the size of a man’s penis are allegedly false and not supported by any credible scientific evidence. The lawsuit further charges that the defendants are already in violation of a court-ordered injunction prohibiting such claims. The case is entitled Williams, et al. v. Biotab Nutraceuticals, Inc. et al.

 

Under the ExtenZe class action settlement, consumers who purchased ExtenZe between May 29, 2005 and October 25, 2010 and who file a valid claim will have the choice to receive a cash refund or a retail package of ExtenZe NASCAR Racing merchandise. Class members who select the retail package may choose the “ExtenZe Mens Retail Package” valued at $149.95 or the “ExtenZe His and Hers Retail Package” valued at $176.94. Details about what’s included in these retail packages can be found under the FAQ section of the Settlement Administrator’s website: www.ExtenZeSettlement.com. Class members who elect to receive a cash refund can, with proof of purchase, get a percentage refund on the previously purchased product.  

 

In order to participate in the ExtenZe settlement, you must submit a valid claim form online or postmarked no later than April 15, 2011. Claim forms can be downloaded and submitted online at www.ExtenZeSettlement.com. If you wish to exclude yourself from the ExtenZe class action lawsuit settlement or object to it, you must do so before January 11, 2011. The Final Approval Hearing will be held on March 30, 2011.

    Tom, I never received a notification either, and I had testicular cancer and had to go through chemo, an orchiectomy – thankfully the doctor had to just take one – and am still receiving care for it five years after I was diagnosed with cancer. Just checkups now, but I still didn’t get anything. Is there anything we can do now?
