Pampa Extra Virgin Olive Oil does not meet the standards to be classified as extra virgin olive oil, according to a false advertising class action lawsuit filed earlier this month against defendant Transnational Foods Inc.

Plaintiff Renee Young says that Transnational Foods, which manufactures, markets and sells Pampa Extra Virgin Olive Oil, misrepresented the product as extra virgin olive oil (EVOO).

According to the Pampa olive oil class action lawsuit, testing by a leading laboratory “conclusively establishes that Pampa EVOO is not Extra Virgin Olive Oil.”

According to the Pampa olive oil false advertising class action lawsuit, Transnational’s misrepresentations about the Pampa EVOO product were designed to lead consumers to believe the product was in fact extra virgin olive oil.

Young says she purchased and consumed Pampa Extra Virgin Olive Oil in June 2018, relying on the label representing the product as extra virgin olive oil.

However, laboratory testing measuring key variables of free fatty acid, peroxide value, specific extinction, ultraviolet absorption, sensory analysis, insoluble impurities, copper, and moisture and volatile content established that Pampa EVOO is not really extra virgin olive oil.

“Accordingly, Defendant’s statements that the ‘Pampa EVOO’ product is Extra Virgin Olive Oil are false and misleading,” Young says in the Pampa class action lawsuit.

Young says she relied on Transnational’s misrepresentations about the product and that she would not have paid as much for Pampa Extra Virgin Olive Oil, or would not have purchased the product at all, if not for the alleged misrepresentations.

“Plaintiff brings this class action lawsuit to enjoin the ongoing deception of consumers by Defendant, and to recover the money taken by this unlawful practice,” the Pampa Extra Virgin Olive Oil class action lawsuit says.

Young filed the Pampa olive oil class action lawsuit on behalf of herself and a proposed Class of California residents who purchased Pampa Extra Virgin Olive Oil during the applicable limitations period.

The Pampa olive oil class action lawsuit asserts claims for violations of California’s Legal Remedies Act; violations of California’s False Advertising Law; negligent misrepresentation; and unlawful, fraudulent and unfair business practices.

The plaintiff is seeking damages, restitution, injunctive relief, pre- and post-judgment interest, attorneys’ fees and costs, and other relief the court deems just and proper. She has demanded a jury trial.

Transnational is not the only company to face legal action over allegedly misrepresenting a product as extra virgin olive oil. The J.M. Smucker Company was recently hit with a false advertising class action lawsuit alleging it falsely marketed its Crisco 100% Extra Virgin Olive Oil No-Stick Spray as being real extra virgin olive oil.
