A car accident lawsuit was recently filed by a Florida woman, alleging that multiple parties from Pennsylvania were responsible for a vehicular accident that caused her serious injuries.
The car accident lawsuit names several people and an inn in Pennsylvania as defendants, for allegedly failing to take action that could have prevented the car accident.
This car accident lawsuit was filed by plaintiff Rebecca M., who alleges the staff and manager of defendant Rosie’s Mingo Inn LLC failed to stop a drunk driver from leaving their premises.
Overview of Car Accident Lawsuit
According to the car accident lawsuit, the incident occurred on Sept. 9, 2016 at 3:39 p.m., while Rebecca had been traveling eastbound on State Route 136 and approaching the parking lot of Rosie’s Mingo Inn in Pennsylvania.
As Rebecca entered the parking lot, defendant and driver Dominick Delbello allegedly collided with her vehicle while trying to exit the parking lot of the inn.
Not long after the collision, the Pennsylvania State Police investigated that incident and arrested Delbello with charges, alleges the complaint. The police confirmed that Delbello had been intoxicated or under the influence of some other substance at the time of the accident.
According to the car accident lawsuit, Rebecca sustained numerous injuries including: bodily harm, severe pain, anxiety, depression, humiliation, and had to undergo several medical treatments. Rebecca says she also sustained financial damages from incurring medical expenses, missing work, and lost wages.
Rebecca states she opted to file this car accident lawsuit, after discovering the circumstances of the incident. According to the car accident lawsuit, the staff at Rosie’s Mingo Inn bar had failed to stop serving Delbello alcohol or prevent him from leaving with the car keys while in his impaired state.
One of the staff members was Krystle Wise, who allegedly managed the bar and sold Delbello alcohol on the day of the incident. Even though Wise was selling Delbello alcohol, she failed to notice his impaired state and did not stop him from leaving, alleges the car accident lawsuit. In addition, the rest of Rosie’s Mingo Inn staff failed to stop Delbello from leaving despite his impaired state.
Rebecca also says the owner of the vehicle Delbello was driving, Edward Fuentes, is responsible because he allegedly allowed Delbello to drive the car despite knowing his history of driving while impaired.
This incident was no different, alleges the car accident lawsuit — Delbello had allegedly become drunk despite knowing he was going to drive and nobody allegedly aware of the situation tried to stop him. The car accident lawsuit ultimately alleges that there were multiple parties that could have prevented this incident, but none of these parties took action.
Rebecca is seeking over $75,000 from each of the defendants named in this car accident lawsuit, along with any other relevant damages. She says that financial compensation from each of these parties can help mitigate any incurring medical expenses related to her injuries, along with the work she has had to miss as a part of her recovery.
In addition, Rebecca alleges that this car accident has greatly impacted her quality of life and will most likely leave her with permanent physical and psychological inflictions.
